OBJECTIVE: amending Regulation (EEC) No 1765/92 in order to ensure a proper balance between supply and demand for durum wheat at a reasonable cost by limiting the compensatory aid additional expenditure on durum wheat to a maximum area. SUBSTANCE: the measures envisaged should only be aimed at guaranteeing the appropriate use of areas sown to durum wheat. To ensure this result, the following action is proposed: 1). the fixing of a guaranteed maximum area per producer Member State, to be allocated, if appropriate, between the various traditional production areas eligible for the compensatory amount supplement (ECU/ha 358.6) and the areas eligible for reduced specific aid (ECU/ha 138.9). The determination of these guaranteed maximum areas would be based on aid applications submitted since the introduction of the reform, in the light of the best year for each Member State; 2). making it mandatory to use certified seed (which would be introduced gradually over a period of three years); 3). measures to ensure a level of production corresponding to the areas sown.

OBJECTIVE: The aim of the proposal for a Council Regulation is to make the system of penalties applied when the base area is exceeded more flexible and to introduce the possibility of sub-base areas being created in a national base area. SUBSTANCE: Firstly, the proposal is intended to exempt Member States from financial penalties arising from overshoots that are the consequence of exceptional weather conditions. That measure will apply from the 1995 harvest and concerns overshoots noted in Spain. The cost of this measure for 1996 is ECU 143.6 million. Secondly, the proposal authorizes Member States that opt to create one or more national base areas, possibly subdivided into sub-base areas, to concentrate any penalties partially or entirely on one or more of those sub-base areas, provided that such redistribution does not lead to an overall reduction in the national penalty. �
