In adopting the report by Mr Dominique SOUCHET (EDN, F), by 456 votes to 9, with 3 abstentions, the European Parliament approved two objectives of the Commission proposal, namely: - to determine the fishing opportunities which the Council, within the limit of the annual total allowable catches, may allocate to third countries, and the technical conditions under which such catches may be made within Community waters; - to confer powers on the Council to determine technical conservation measures of a temporary nature relating to the conditions under which the quotas may be fished. However, Parliament opposed the delegation of powers to the Commission for incorporating in the Community legal order provisions concerning technical measures on fishing gear and its method of use adopted by international fisheries organizations to which the Community is a contracting party. Such a delegation of powers would have effectively cut the European Parliament off from the decision-making process with regard to a significant part of the common fisheries policy. The procedure under Article 43 TEU (consultation) is the only means whereby Parliament can be given adequate knowledge of the decisions adopted in organizations such as the International Baltic Sea Fisheries Commission or the North-West Atlantic Fisheries Organization (NAFO). �

OBJECTIVE: to amend Regulation (EEC) No 3760/92 establishing a Community system for fisheries and aquaculture. SUBSTANCE: the aims of the proposal for a Council Regulation are as follows: - to confer powers on the Commission as regards the technical measures on fishing gear and its method of use incorporating, in the Community legal area, binding acts adopted by international fisheries organizations to which the Community is a contracting party; - to confer powers on the Council as regards establishing the fishing opportunities to be allocated to third countries and setting the technical conditions under which catches must be made; - to provide that the temporary technical conservation measures associated with the conditions under which the quotas can be fished may be adopted using the same procedure as that laid down for establishing the total allowable catch. �
