In adopting the report by Mr Edward T. KELLETT-BOWMAN (PPE, UK) on the amendments to the basic regulation on the Community Trade Mark Office, Parliament welcomed the Commission proposal, which addressed issues of long-standing concern to Parliament with regard to the discharge and financial control of the decentralized bodies. However, Parliament called for: -all of the Office's revenue to be budgetized and regarded as preallocated resources of the European Union, -all surplus revenue to be paid back into the general budget of the Union, -no amounts to be taken out of the reserve in the Office's budget without the agreement of Parliament, -the Financial Controller to ensure that the necessary practical arrangements are in place to allow swift and effective processing of the Office's financial transactions and to prevent excessive recourse to the use of imprest accounts, -the Commission to evaluate the level of the fees received by the Office after three years. It also recalled that it was a prerequisite to involve Parliament in the discharge procedure.�

OBJECTIVE: to amend Regulation (EC) No 40/94 establishing the Community Trademark Office in order to modify the regulatory framework governing the management of the Office's budget. CONTENT: the proposed changes relate to: - power of discharge: as this body is partly self-sufficient as far as its resources are concerned, a joint power of discharge is proposed. Discharge will be given by the budgetary committee of the Trademark Office, at the recommendation of the European Parliament; - own resources: as the Office has resources other than those from its annual budgetary allocation, it is proposed that surplus revenue be paid back into the general budget of the European Union once a reserve has been set up to meet any future expenditure. The sums allocated to this reserve must be agreed by the Commission, after consulting the European Parliament; - financial control: financial control of the Office will be carried out by the Commission's Financial Controller.�
