  The European Parliament adopted with 389 votes for, 75 against and 32 abstentions the report drafted by Mr. Giorgio NAPOLETANO (PES, I) without making any amendments to the text approved by the Constitutional Affairs Committee. The decision adopted by the Parliament regarding the terms and conditions of the European Anti-Fraud Office's (OLAF) internal investigations specifies, in regard to the obligation to provide information, that all Parliament officials or agents who learn of aspects which would lead them to suspect the possible existence of a case of fraud, corruption or any other illegal activity or serious facts that could constitute a non-respect of officials' or agents' obligations, will immediately inform their head of service or director-general or, if it is a case of non-respect of the analogous obligations of Members, the President of the European Parliament. The report, furthermore, maintains the provision that stipulates that Members who have learnt about analogous facts are obliged to inform the President of the EP or, if they consider it useful, OLAF directly. The information obligation must, however, respect the criteria of confidentiality laid down either in texts of a legislative character or in the Parliament's Rules of Procedure. The rules regarding Members' parliamentary immunity and the right to refuse to bear witness remain unchanged. The report retains practically all the other provisions identical to its previous version.�
