The Council fully accepts the principle of the Parliament's proposed amendments: that the two acts should take effect as soon as practicable. It believes that the Regulation should apply, and the implementation of the Directive should have to be completed, six months after their entry into force. The common position adopted by the Council with a view to the adoption of the Directive would therefore require Member States to implement the provisions of the Directive by the date of application of the Regulation. There is also a new provision, which makes it clear that Member States can regulate the importation and placing on the market of products for which the Annexes to the Regulation contain no rules. The similar rule in Article 3 of Directive 92/118/EEC is no longer necessary. The common position would restrict its scope to products of animal origin intended for human consumption.�

In adopting the report presented by Marit PAULSEN (ELDR, S), (please refer to previous doculent) the European Parliament welcomed that these various acts be replaced by a single new directive, but adopted the one amendment proposed by the rapporteur, namely that the directive should take effect at the same time as the proposed regulation on animal by-products intended for human consumption i.e. 1 January 2002 instead of 1 February 2003.�

PURPOSE : to present a proposal which amends Council Directives 90/425/EEC and 92/118/EEC as regards health requirements for animal by-products. CONTENT : the animal and public health conditions for the processing and disposal of animal waste and for the production, placing on the market, trade and importation of products of animal origin not intended for human consumption are laid down in a number of different Council Directives and Decisions and Commission Decisions. The rules contained in those Directives and Decisions have been replaced by Regulation.../... of the European Parliament and of the Council laying down the health rules concerning animal by-products not intended for human consumption. Directives 90/425/EEC and 92/118/EEC must therefore be amended accordingly. This is the scope of this Directive.�
