    The Council held a debate on the outstanding problems in the Commission proposals to amend: - Decision 97/413/EC concerning the objectives and detailed rules for restructuring the Community fisheries sector for the period from 1 January 1997 to 31 December 2001 with a view to achieving a balance on a sustainable basis between resources and their exploitation; - Regulation 2792/1999/EC laying down the detailed rules and arrangements regarding Community structural assistance in the fisheries sector. In general, the purpose of the Commission proposals is - pending the review of the CFP - to extend MAGP IV by one year while introducing certain more restrictive provisions on access to State aid. The Council debate was based on compromise suggestions by the Presidency, since the Commission proposals had met with opposition from some of the Member States. A number of them wanted to see the fourth MAGP extended by one year with the current provisions being maintained, while others could to varying degrees accept the Commission's approach. The Presidency's compromise suggestions were intended to tone down some of the provisions proposed by the Commission. Nonetheless at the end of the debate the Presidency had to conclude that it was not possible at this stage to unite all the delegations behind the Presidency's compromise; the Commission made clear that it was maintaining its proposals in full. The Presidency would continue to reflect on the best way to continue work on the subject, and indicated that the matter could be reconsidered at the Council meeting on 17 and 18 December 2001.�

    The European Parliament adopted the proposal on restructuring the fishing industry with a number of non-binding amendments. The House takes the view that as the Common Fisheries Policy is due for a major overhaul next year, there is no point in introducing far reaching changes at this stage, especially as these could have an adverse effect on maritime safety. The amendments made to the report by Mrs Elspeth ATTWOOLL (ELDR, UK) therefore seek to delete certain provisions in the proposal.�

    PURPOSE : to prolong Council Decision 97/413/EC by one year, (31 December 2002), and thereby extend MAGP IV. CONTENT : in a recent communication to the Council, the Commission regretted the inadequacy of the existing measures to contain fishing effort under the fourth generation of multiannual guidance programmes (MAGP IV). This situation, which can be considered a weakness of the CFP, must be rectified by courageous and effective measures. To this end, the Commission has therefore prepared a proposal for the prolongation by one year, that is until 31 December 2002, of the Decision currently in force, thus also prolonging by one year the MAGP IV, as well as a proposal for modifications to certain provisions of the Financial Instrument for Fisheries Guidance (FIFG). Given the Commission's concern that the objectives of the MAGP IV are too modest, any prolongation should at least be associated with measures to make them more effective. Therefore, the attached proposal removes the possibilities that currently exist under Council Decision 97/413/EC to increase the MAGP objectives on the grounds of safety. All the new vessels should be constructed to a certain minimum standard of safety, and the capacity to build these new vessels could be found from within the existing capacity objectives. For the same reason, the proposed modification of the FIFG Regulation also introduces new contraints (refer to CNS/2001/0129). �
