The Council's common position, unanimously adopted, includes a number of proposed changes to the Commission's original proposal. It shares the overall objective of the Commission's proposal and in general terms, the proposed means of attaining that objective. However, the text of the proposal has been reworded in the course of discussion within the Council. Moreover, some articles were restructured to enhance clarity and user-friendliness. The common position has re-structured Article 2 (Specific actions) to align it with Article 1 (Objectives of the decision) and the four actions included in the proposed programme. Moreover, in these articles, the local level has been given a parallel status to national and regional levels in the framework of good practices and exchange of experiences. The Council has also enforced the impetus given to achieving the objectives of the eEurope 2005 Action Plan. In this context, it added a reference to an eEurope Steering Group. As far as network and information security is concerned, the 'cyber-security task force' referred to in the Commission's proposal has been termed 'future structure at European level for network and information security issues'. This is due to the fact that, since the present Commission's proposal, a new Commission proposal for the establishment of a European Network and Information Security Agency was issued, and the final form of this structure is currently not decided. However, the need to prepare this structure, which is to be operative from the beginning of 2004, is underlined. On the basis of the experience from the preceding programme PROMISE and given unfortunate delay in the adoption of the programme, the financial reference amount now proposed in the common position is EUR 20 million (as opposed to EUR 25 million proposed by the Commission). The Council has broadened the scope of the involvement of the management committee in order to ensure sufficient control over the implementation of the programme while avoiding unnecessary bureaucracy. Lastly, the common position provides for the possibility of opening the programme to EEA countries, applicant and candidate countries as well as the association countries of central and eastern Europe. Moreover, co-operation with nonmember countries and international organisations or bodies is encouraged.�

The European Commission has been able to accept four of the proposed amendments in full. They relate to: - The inclusion of a recital relating to a "networks and information society." - Proposing a reference to the eEurope 2005 Action plan and its objective of creating a Cyber security task force. This should become a centre of competence on matters relating to security. - Replacing the word "two-tier-society" with the word "digital exclusion". - Requiring Member States to offer the Commission the most recent data and statistics available. Those accepted in part or in principle by the Commission are as follows: - Inclusion of the disadvantaged in the proposal. However, the Commission does not want to limit the scope of the proposed Directive through an explicit list of disadvantaged people as originally suggested by the European Parliament. - Merging two Parliamentary amendments on the extension of the programme to the Accession countries, EEA, associated countries of Central and Eastern Europe and Turkey. - To include references relating to social inclusion in order to avoid the risk of creating a digital divide. - Replacement of the words "Cyber-security task force" with the words "Network and Information Security Agency." - A simplification of the amendment on opening up the programme to countries of the EEA area, the Accession Countries and Turkey. The Commission is unable to accept an amendments which proposes: - The "advisory committee" should be replaced by a "management committee".�

summary
PURPOSE : to adopt a multi-annual programme (2003-2005) for the monitoring of the eEurope 2005 Action Plan, dissemination of good practices and improvement of network and information security (MODINIS). CONTENT : it is proposed that a financial support programme be adopted to accompany national efforts for the transformation of Europe into a knowledge-based economy. The duration of the programme shall be 3 years (2003-2005) with a budget of EUR 25m. This programme will contribute substantially to the Lisbon strategy and have the following objectives: i) to monitor performance of and within Member States and to compare them with the best in the world and carry out appropriate policies by using where possible official statistics, which have evolved considerably in this sector over the past few years; ii) to support efforts made by Member States in the framework of eEurope at national or regional level by analysis of eEurope specific good practices and by developing mechanisms to exchange experiences; iii) to analyse the economic and societal consequences of the Information Society with a view to appropriate policy responses, particularly in terms of industrial competitiveness and cohesion; iv) to enhance national and European efforts for improving network and information security and to foster the development of broadband rollout. In order to achieve these objectives, the programme will finance the following types of actions: - data collection and analysis concerning a revised set of benchmarking indicators; - studies to identify good practices in Europe; - workshops and studies to analyse the adjustment of industry to the structural change generated by digital technologies and the transformation of society; - support of the Information Society Forum consisting of web-based experts representing a broad range of interests advising the Commission on challenges for the development of the Information Society; - support of targeted conferences, seminars or workshops in order to promote cooperation and exchange of experiences and good practices between interested parties and Member States; - financing of specific surveys, studies and expertise gathering activities in the area of network and information security (e.g. security mechanisms and their interoperability, network reliability and protection, advanced cryptography, confidentiality and security in wireless communications), in particular on existing or emerging threats and also with a view to prepare the activities of the network security task force.�
