PURPOSE : to propose technical amendments to Regulation 1734/94/EC governing the financial and technical co-operation with the Occupied Territories. CONTENT : following on from the Oslo Peace accords the EU adopted, in 1994, a Regulation on financial and technical co-operation to be carried out with the Occupied Territories (later renamed into co-operation with the West Bank and Gaza strip.) The Regulation stipulates that its provisions should be carried out on five-year programmes. Further, in 1998 it was agreed that the Regulation should be brought into line with the MEDA Regulation - particularly vis-à-vis the potential beneficiaries. A number of recent events have meant, however, that both of these requirements are no longer viable. Firstly, the on-going volatility in the area. The on the ground uncertainty makes it impossible to sustain five-year programmes. Secondly, the new financial Regulation and Decision laying down procedures for the exercise of implementing powers has made an amendment to the existing regulation necessary. The amendments propose that: - circumstances permitting the implementation of the Regulation should be based on pluri-annual programmes; - the European Commission should provide a report reviewing the Regulation by the end of 2005; - support measures on financial and technical matters should accompany the MEDA reform of economic and social structures programmes; - financial commitments will be liable to OLAF on the spot checks. FINANCIAL STATEMENT : - Budget line: 190803 (ex-B7-42); - Period of allocation : 2004-2006; - Total allocation for action 190803 : EUR 47.75 annually; - Impact on human resources : 5 A grade permanent staff (existing); 4 B grade permanent posts (existing) 2 C grade permanent staff (existing) and one (existing) temporary post.�
