The European Parliament adopted the resolution drafted by Jan MULDER (ELDR, NL) and Neena GILL (PES, UK) on the draft amending budget No 4 of the European Union for the financial year 2004 - Revision of the Staff Regulations. The European Parliament welcomes the agreement reached at the trialogue meeting of 16 March 2004 on the rules relating to recruitment in 2004 prior to and after the entry into force of the new Staff Regulations, as outlined in the attached Joint Declaration of the Budgetary Authority. A joint declaration was issued which states that: - the recruitment of staff is regulated by the relevant provisions of the Staff Regulations. Accordingly, all institutions will apply the following rules in 2004: - all officials recruited before the 1st of May 2004 will be classified in accordance with Article 2 of Annex XIII to the new Staff Regulations; - all officials recruited after the 1st of May 2004 will be classified in accordance with the new Staff Regulations, in particular Articles 5, 12 and 13 of Annex XIII, whether they are recruited to new posts or to vacant posts. The declaration states that during the preparation of the first reading of the 2005 budget and in time for decisions to be agreed at the Budget conciliation in July, each institution, office or agency will be required to report to the Budgetary Authority on the implementation of the revised staff grade structure and the effects on their establishment plan. If needed in respect of 2004, each institution, office or agency will propose an adjustment of its establishment plan in so far as the actual occupancy of posts diverges from the conversion of the establishment plan as approved in April 2004. Such proposals will take into consideration the requirements mentioned above and the need for vacant posts at every grade in the establishment plan for normal recruitment and promotion purposes in accordance with the Staff Regulations. The Parliament also considers that each institution should have clear rules on setting up new units. It points out that the Budgetary Authority should be kept informed about the creation of new units, as these will have a budgetary implication, and that each institution should include a list of units in their estimates.�

On 26 March 2004, the Council established draft amending budget No 4 for the financial year 2004. The Council has proceeded, after consultation of the relevant institutions, to a technical adjustment of the establishment plans of the various institutions taking into account the latest situation as regards the provisions of the Staff Regulations. The modifications made by the Council are based on the following principles: - after 1 May 2004, officials should be recruited and graded in accordance with the transitional provisions of Annex XIII of the new Staff Regulations, Articles 12 and 13 (this includes the late changes to these Articles); - however, the establishment plans have to take into account the need for an appropriate number of vacant posts in those circumstances where Articles 12 and 13 cannot apply, which is mainly: - the recruitment of officials in accordance with article 5 of Annex XIII (transfers between categories); - the need to implement the promotions of 2004, - the recruitment of temporary agents on permanent posts when no suitable lists of laureates of competitions are available (this might also be the case for recruitment from new Member States to additional posts granted for 2004); - the transfer of officials from other institutions; - the reinstatement after secondment and leave on personal grounds of officials; - in order to allow for recruitment of existing officials, cabinet posts have not been modified; - the situation will be re-examined in June 2004 in accordance with the Declaration of the Budgetary Authority on amending budget No 4/2004, as agreed on 16 March 2004. Upon the request of the European Parliament made without prejudice to its final decision on amending budget No 4/2004 and without creating a precedent in the application of the Gentlemen's Agreement, technical modifications to its establishment plan are also incorporated in this draft amending budget.�

PURPOSE: presentation of a fourth draft amending budget to adapt the 2004 budget to the changes arising from the revision of the Staff Regulations of Officials and Conditions of Employment of Other Servants of the European Communities. CONTENT: This preliminary draft amending budget seeks to adapt all the sections of the 2004 budget to the changes made by the revision of the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Communities. As the overall budgetary repercussions of the reform have already been incorporated into the appropriations of the 2004 budget, this preliminary draft amending budget relates mainly to the establishment plans, which have to be changed for the entry into force of the reform of the Staff Regulations scheduled for 1 May 2004, and the adjustment of the structure of the budget in order to permit implementation of the new provisions laid down in the Staff Regulations (consideration of a new category of personnel, "contract staff"). It also updates a number of budget remarks and various references to the legal bases introduced by this reform. These changes to the budget will enter into force at the same time as the new Staff Regulations. This amending budget is based on the Financial Regulation (Articles 46 and 47 concerning the establishment plans) and the amended proposal for a Council Regulation amending the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Communities, approved by the Commission on 18 November 2003, which will apply during the transitional period planned for the reform.�
