LEGISLATIVE ACT: Regulation (EC) No 1165/2008 of the European Parliament and of the Council of 19 November 2008 concerning livestock and meat statistics and repealing Council Directives 93/23/EEC, 93/24/EEC and 93/25/EEC.
CONTENT: t he Council adopted a Regulation establishing a common legal framework for the production of Community statistics on livestock and meat in Member States, following an agreement at 1 st reading with the European Parliament The Regulation establishes a common legal framework for the systematic production of Community statistics on livestock and meat production in Member States, in particular:
(a) statistics on bovine, pig, sheep and goat livestock;
(b) slaughtering statistics on bovine animals, pigs, sheep, goats and poultry; and
(c) production forecasts of beef, veal, pigmeat, sheepmeat and goatmeat.
The statistics referred to in the Regulation are essentially for the management and evaluation of the common agricultural policy.
In order to ensure a smooth transition from the regime applicable under Directives 93/23/EEC, 93/24/EEC and 93/25/EEC, this Regulation allows for the granting of a derogation from its application until 1 January 2010 or, in the case of statistics on sheep and goats, until 1 January 2011, where the application of the Regulation to the national statistical system of a Member State necessitates major adaptations and is likely to cause significant practical problems.
Every 3 years, and for the first time by 1 July 2011, Member States must provide the Commission (Eurostat) with a report on the quality of the data transmitted.

ENTRY INTO FORCE: 21/12/2008.
The European Parliament adopted, by 636 votes to 13 with 10 abstentions, a resolution amending the proposal for a regulation of the European Parliament and of the Council concerning meat and livestock statistics. The report was tabled for consideration in plenary by Friedrich-Wilhelm GRAEFE ZU BARINGDORF (Greens/EFA, DE) on behalf of the Committee on Agriculture and Rural Development.
The main amendments, adopted in the first reading of the codecision procedure, are as follows:
-some of the provisions, previously set out in the annexes, are clarified in the legislative text (in particular the definitions in Article 2 and the quality assessment in Article 17);
-from now on, Member States will have more room for manoeuvre in making use of administrative data rather than statistical surveys: in the case of use of administrative sources, Member States shall inform the Commission in advance about methods used and the quality of data. In the case of sources other than surveys, Member States will ensure this information is of at least equal quality to information obtained from statistical surveys;
- qualification as regards regional surveys: in order to limit the burden on Member States, the regional data requirements should not exceed the requirements under previous legislation. These requirements are optional for territorial units having less than 150 000 pigs, 75 000 bovine animals, 100 000 sheep and 25 000 goats if these territorial units summed up together contribute with 5% or less to the national population of the relevant species;
- transitional period : in order to ensure a smooth transition from the regime applicable under Directives 93/23/EEC, 93/24/EEC and 93/25/EEC, the Regulation should allow a transitional period of up to one year and, in the case of sheep, up to two years, to be granted to Member States where the application of this Regulation to their national statistical systems would require major adaptations and would be likely to cause significant practical problems.
- transmission deadlines : Parliament has amended some of the deadlines for transmission of the definitive statistics on livestock, for slaughtering in slaughterhouses and outside slaughterhouses, and meat production forecasts.
- frequency and reference period : the forecasts for pigs shall be produced twice a year by each Member State. Those Member States whose pig population is less than 3 million heads may produce these statistics only once a year. The forecasts for bovine animals shall be produced twice a year by each Member State . Those Member States whose bovine population is less than 1.5 million heads may produce these statistics only once a year. The reference periods were also amended.
- quality assessment and reports : Parliament inserted definitions for several terms, including "relevance", "accuracy", "timeliness" and "punctuality". Every three years, and for the first time eighteen months after the application of the current Regulation, Member States shall provide the Commission (Eurostat) with a report on the quality of the data transmitted. The quality reports shall describe: a) the organization of the surveys covered by the Regulation and methodology applied; b) the levels of precision achieved for the sample surveys referred to in this Regulation; c) the quality of sources used other than surveys, and d)the quality of the forecasts referred to in the Regulation;
-MEPS ask that the regulatory procedure with scrutiny be applied to comitology provisions, including the provisions on quality reports, the granting of transitional periods to Member States and the modifications of Annexes I, II, IV and V;
-the terminology used should be in line with the internationally agreed zoological nomenclature;
-lastly, the Regulation shall apply from 1 January 2009.
The Committee on Agriculture and Rural Development adopted the report by Friedrich-Wilhelm GRAEFE ZU BARINGDORF (Greens/EFA, DE) amending, under the codecision procedure, the proposal for a regulation of the European Parliament and of the Council concerning meat and livestock statistics.
The proposed amendments are of a technical nature and correspond (with a small number of exceptions) to the wording drawn up by the Council working party and forwarded by the Portuguese presidency on 28 December 2007, in order to enable a first reading agreement to be reached. The amendments are as follows:

PURPOSE: to establish a common framework for the systematic production of Community statistics on livestock and meat production
PROPOSED ACT: Regulation of the European Parliament and of the Council.
CONTENT: this proposal comes about as a result of the Communications of 14 November 2006 on a strategic review of Better Regulation in the EU and on reduction of the response burden, simplification and priority-setting in the field of Community statistics. (Please refer to COM(2006)0693).
Statistics on meat and livestock are essential for the management of the EU markets. The current legislation had become so complex that both vertical and horizontal codification was envisaged, but this did not appear to be the most efficient way towards better legislation. It was also considered essential for poultry meat statistics to be covered in addition to pig, bovine, sheep and goat meat statistics.
Accordingly, the objective of this proposal is the provision by the EU Member States of statistics on livestock (twice a year on pigs and bovine animals and every year on sheep and goats), monthly statistics on slaughterings (heads and carcass weights of pigs, bovine animals, sheep, goats and poultry), and forecasts of meat production (pig meat, bovine meat, sheep and goat meat).
There is no obligation for the Member States to make any changes in their administrative systems relating to the production of meat and livestock statistics. The only new item proposed for data collection in this Regulation is for poultry, which is already being implemented at EU level under a gentleman’s agreement.
The requirement for statistics instead of survey results, the reduced frequency of some data submissions and the option of making greater use of sources other than surveys (e.g. administrative sources) should reduce the financial and administrative burden on national authorities.
The reduced breakdown of data by regions and by herd size, the reduced frequency of pig surveys, the exemptions granted to the Member States with animal populations under certain thresholds, and the harmonised transmission deadlines will simplify the work for the EU and national administrations.
On coverage, the proposal states that Member States must produce statistics relating to the number of pigs, bovine animals, sheep and goats held on agricultural holdings within their territory. Member States conducting sample surveys shall cover sufficient agricultural holdings to account for at least 95% of the entire population, as determined by the last survey on the structure of agricultural holdings.
Lastly, the existing legislation, Council Directive 93/23/EEC on the statistical surveys to be carried out on pig production, Council Directive 93/24/EEC on the statistical surveys to be carried out on bovine animal production and Council Directive 93/25/EEC on the statistical surveys to be carried out on sheep and goat stocks, will be repealed.
