Details

PURPOSE: to codify Council Directive 77/311/EEC relating to the driver-perceived noise level of wheeled agricultural or forestry tractors.

LEGISLATIVE ACT: Directive 2009/76/EC of the European Parliament and of the Council relating to the driver-perceived noise level of wheeled agricultural or forestry tractors.

CONTENT: Council Directive 77/311/EEC of 29 March 1977 on the approximation of the laws of the Member States relating to the driver-perceived noise level of wheeled agricultural or forestry tractors has been substantially amended several times. Thus, in the interests of clarity and rationality the Directive should be codified.

The new Directive will supersede the various acts incorporated in it. It fully preserves the content of the acts being codified and hence does no more than bring them together, with only such formal amendments as are required by the codification exercise itself.

ENTRY INTO FORCE: 21/08/2009.

The European Parliament adopted a legislative resolution based on the report drafted by Francesco Enrico SPERONI (UEN, IT) approving, under the first reading of the codecision procedure, the proposal for a directive of the European Parliament and of the Council relating to the driver-perceived noise level of wheeled agricultural or forestry tractors (codified version).

Details

The Committee on Legal Affairs adopted the report drafted by Mr Francesco Enrico SPERONI (UEN, IT) approving, under the first reading of the codecision procedure, the proposal for a directive of the European Parliament and of the Council relating to the driver-perceived noise level of wheeled agricultural or forestry tractors (codified version).

Although the proposal was not the subject to any ‘formal’ amendments by the committee, it incorporates the recommendations of the Consultative Working Party of the legal services of Parliament, the Council and the Commission who made a certain number of technical remarks regarding the text of the codified proposal.

The only modification made to the draft codification relates to Annex I, point 2.7, and Annex II, point 2.7 of the proposal: in each case, in the French text, of the word " reflétante " is replaced by the word " réfléchissante ".

Apart from that one point, the proposal was indeed a straightforward codification involving no substantive changes to the acts concerned.

Details
