  • The European Parliament decided to waive the immunity of Jacek Olgierd KURSKI (EFD, PL).

    To recall, Mr KURSKI is accused of committing a road traffic offence. The alleged action does not have a direct, obvious connection with Jacek Olgierd KURSKI’s performance of his duties as a Member of the European Parliament nor does it constitute an opinion expressed or a vote cast in the performance of the duties of the Member of the European Parliament for the purposes of Article 8 of Protocol No 7 on the Privileges and Immunities of the European Union. There is therefore no reason to suspect the existence of a fumus persecutionis.

    Consequently, the European Parliament decided to waive the parliamentary immunity of Jacek Olgierd KURSKI.

  • The Committee on Legal Affairs adopted the report by Cecilia WIKSTRÖM (ALDE, SE) in which it recommends that the European Parliament should waive the immunity of Jacek Olgierd KURSKI (EFD, PL).

    The Office of the Public Prosecutor General of the Republic of Poland sent a request to waive the parliamentary immunity of Jacek Olgierd KURSKI. Mr KURSKI is accused of committing a traffic offence by making a left turn in breach of horizontal road sign B-21 (‘no left turns’) and vertical road sign P-4 (double continuous lines’) with the result that he crossed those lines, thereby committing an offence under Article 92(1) of the Act of 20 May 1971 establishing a Code of Offences (Polish Journal of Laws 2010 No 46, item 275, as amended).

    The committee considers that the alleged action does not have a direct, obvious connection with Jacek Olgierd KURSKI’s performance of his duties as a Member of the European Parliament nor that it constitutes opinions expressed or votes cast in the performance of the duties of the Member of the European Parliament for the purposes of Article 8 of Protocol No 7 on the Privileges and Immunities of the European Union.

    The accusation has no connection with Mr Kurski’s office of Member of the European Parliament. Mr KURSKI has been heard, and there is no reason to suspect the existence of a fumus persecutionis.

    On the basis of the above considerations, after considering the reasons for and against waiving the Member’s immunity, it is recommended that the European Parliament should waive the parliamentary immunity of Jacek Olgierd KURSKI.
