PURPOSE: to adapt the projected energy consumption figures for the European Union in 2030 to reflect the Union of 27 Member States.

LEGISLATIVE ACT: on amending Directive 2012/27/EU on energy efficiency and Regulation (EU) 2018/1999 on the Governance of the Energy Union and Climate Action, by reason of the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the Union.

CONTENT: by amending Directive 2012/27/EU on energy efficiency and Regulation (EU) 2018/1999 on the governance of the energy union, this Decision aims to technically adjust the figures for energy consumption by 2030 to correspond to the Union of 27 Member States.

The projections for the EU 27 show that primary energy consumption should be equal to 1 128 Mtoe and final energy consumption should be equal to 846 Mtoe in 2030. This requires the amendment of the figures for energy consumption levels in 2030.

Member States shall take into account the projections for the EU27 when notifying the Commission of national indicative energy efficiency contributions towards the EU target for 2030 as part of their integrated national energy and climate plans.

ENTRY INTO FORCE: 28.3.2019. The Regulation shall apply on the day following the date on which Directive 2012/27/EU and Regulation 2018/1999/EU cease to apply in the United Kingdom.

Details

The European Parliament adopted by 540 votes to 13, with 53 abstentions, a legislative resolution on the proposal for a decision of the European Parliament and of the Council on adapting Directive 2012/27/EU of the European Parliament and of the Council on energy efficiency [as amended by Directive 2018/XXX/EU] and Regulation (EU) 2018/XXX of the European Parliament and of the Council [Governance of the Energy Union], by reason of the withdrawal of the United Kingdom from the European Union.

The European Parliament adopted its position at first reading in accordance with the ordinary legislative procedure.

The proposed decision is made necessary by the upcoming withdrawal of the United Kingdom from the European Union. In this respect, it is proposed to technically adapt the projected energy consumption figures for the European Union in 2030 to reflect the Union of 27 Member States (EU 27).

The amendment to Directive 2012/27/EU provides that when setting national indicative energy efficiency contributions to achieve the Union's objectives for 2030, Member States should take into account that the Union's energy consumption in 2030 should be equal to 1 128 Mtoe and final energy consumption should be equal to 846 Mtoe in 2030. Member States shall notify those contributions to the Commission as part of their integrated national energy and climate plans.

The Decision shall apply from the day following the day on which Directive 2012/27/EU and Regulation (EU) 2018/1999 cease to apply in the United Kingdom.

The Committee on Industry, Research and Energy adopted the report by Miroslav POCKET (S&D, CZ) on the proposal for a decision of the European Parliament and of the Council on adapting Directive 2012/27/EU of the European Parliament and of the Council on energy efficiency [as amended by Directive 2018/XXX/EU] and Regulation (EU) 2018/XXX of the European Parliament and of the Council [Governance of the Energy Union], by reason of the withdrawal of the United Kingdom from the European Union.

Due to the United Kingdom’s withdrawal from the Union, it is necessary to technically adapt the projected energy consumption figures for the European Union in 2030 to reflect the Union of 27 Member States (EU 27).

Projections made for the at least 32.5 % Union headline targets show that primary energy consumption should equal 1 273 million tonnes of oil equivalent (Mtoe) and 956 Mtoe of final energy consumption in 2030 for the Union of 28 Member States. The equivalent projections for the EU 27 excluding the United Kingdom show that primary energy consumption should equal 1 128 Mtoe and final energy consumption should equal 846 Mtoe in 2030.

Therefore, it is proposed to adapt the figures for primary and final energy consumption provided for in the recent amendment of the Energy Efficiency Directive.

The committee recommended that the European Parliament's position adopted at first reading under the ordinary legislative procedure should amend the Commission's proposal as follows.

The proposed amendments aim in particular to:

- introduce in the recitals a technical clarification in relation to the Union’s energy efficiency targets for 2030, to reflect more accurately the terminology used in the recently agreed revision of the Energy Efficiency Directive. It should be noted that the Directive refers to headline targets (in plural), to reflect that the target for energy efficiency is expressed in primary/final energy consumption ;

- clarify that the Decision should be without prejudice to the transposition of the recently agreed Directive on energy efficiency, and not that of Directive 2012/27/EU which has been already transposed. This Decision provides a general transposition date of 5 June 2014;

- change of the date of entry into force of the Decision (three days instead of twenty following its publication in the Official Journal of the European Union), in order to ensure that it can enter into force before the day on which Union law ceases to apply to the United Kingdom. This change seems necessary in view of the time constraints for the completion of the legislative procedure before 29 March 2019.

PURPOSE: to adapt Directive 2012/27/EU of the European Parliament and of the Council on energy efficiency due to the withdrawal of the United Kingdom from the European Union.

PROPOSED ACT: Decision of the European Parliament and of the Council.

ROLE OF THE EUROPEAN PARLIAMENT: the European Parliament decides in accordance with the ordinary legislative procedure and on an equal footing with the Council.

BACKGROUND: on 29 March 2017, the United Kingdom notified the European Council of its intention to withdraw from the Union pursuant to Article 50 of the Treaty on European Union. Consequently, unless another date is established in a withdrawal agreement, or the European Council, in agreement with the United Kingdom, unanimously establishes another date, Union law will cease to apply to the United Kingdom from 30 March 2019.

The United Kingdom will then become a third country .

CONTENT: this proposal for a Decision of the European Parliament and the Council adapting Directive 2012/27/EU [as amended by Directive 2018/XXX/EU] on energy efficiency and the Regulation (EU) 2018/XXX [ Governance of the Energy Union ] is necessitated by the upcoming withdrawal of the United Kingdom from the European Union.

Projections made for the at least 32.5 % Union headline targets show that primary energy consumption should equal 1 273 million tonnes of oil equivalent (Mtoe) and 956 Mtoe of final energy consumption in 2030 for the Union of 28 Member States. The equivalent projections for the EU 27 excluding the United Kingdom show that primary energy consumption should equal 1 128 Mtoe and final energy consumption should equal 846 Mtoe in 2030. Therefore, it is proposed to adapt the figures for primary and final energy consumption provided for in the recent amendment of the Energy Efficiency Directive. The committee recommended that the European Parliament's position adopted at first reading under the ordinary legislative procedure should amend the Commission's proposal as follows. The proposed amendments aim in particular to: - introduce in the recitals a technical clarification in relation to the Union’s energy efficiency targets for 2030, to reflect more accurately the terminology used in the recently agreed revision of the Energy Efficiency Directive. It should be noted that the Directive refers to headline targets (in plural), to reflect that the target for energy efficiency is expressed in primary/final energy consumption ; - clarify that the Decision should be without prejudice to the transposition of the recently agreed Directive on energy efficiency, and not that of Directive 2012/27/EU which has been already transposed. This Decision provides a general transposition date of 5 June 2014; - change of the date of entry into force of the Decision (three days instead of twenty following its publication in the Official Journal of the European Union), in order to ensure that it can enter into force before the day on which Union law ceases to apply to the United Kingdom. This change seems necessary in view of the time constraints for the completion of the legislative procedure before 29 March 2019.

    PROPOSED ACT: Decision of the European Parliament and of the Council.

    ROLE OF THE EUROPEAN PARLIAMENT: the European Parliament decides in accordance with the ordinary legislative procedure and on an equal footing with the Council.

    BACKGROUND: on 29 March 2017, the United Kingdom notified the European Council of its intention to withdraw from the Union pursuant to Article 50 of the Treaty on European Union. Consequently, unless another date is established in a withdrawal agreement, or the European Council, in agreement with the United Kingdom, unanimously establishes another date, Union law will cease to apply to the United Kingdom from 30 March 2019.

    The United Kingdom will then become a third country.

    CONTENT: this proposal for a Decision of the European Parliament and the Council adapting Directive 2012/27/EU [as amended by Directive 2018/XXX/EU] on energy efficiency and the Regulation (EU) 2018/XXX [Governance of the Energy Union] is necessitated by the upcoming withdrawal of the United Kingdom from the European Union.

    In this regard, it is necessary to technically adapt the projected energy consumption figures for the European Union in 2030 to reflect the Union of 27 Member States.
