Draft opinion Paragraph 1 – point a (new) (a) A. whereas the tasks of the Agency have expanded overtime to meet new maritime policy orientations and priorities; whereas the European Green Deal has emphasised the need to accelerate the transition to a zero pollution and climate neutral economy, including through the shift to sustainable mobility with the contribution of maritime transport; whereas the political orientations in the area of transport are reflected in the Sustainable and Smart Mobility Strategy adopted in December 2020, which announced the revision of EMSA’s mandate in its accompanying Action Plan;

Draft opinion Paragraph 5 5. Welcomes the fact that in 2020 the Internal Audit Service of the Commission and the European Court of Auditors did not issue any critical recommendations or observations that could lead to a reservation in the annual declaration of assurance; however, stresses the need to minimise risks for internal budgetary control weaknesses as much as possible1a but welcomes the Agency’s measures of June 2021 as a response to that; _________________ 1aECA annual report on EU agencies for the financial year 2020, p. 130

Draft opinion Paragraph 5 a (new) 5 a. Highlights that maritime safety and environmental legislation is being updated in parallel with the launch of the revision of EMSA’s mandate; furthermore, highlights the role EMSA could play in enhancing risk-assessment capabilities in safety domains, including for alternative fuels infrastructure deployment; therefore stresses that adjustments may need to be made accordingly in EMSA’s mandate to ensure the Agency can enhance its support, possibly accompanied by budgetary means;

Draft opinion Paragraph 5 a (new) 5 a. Notices that according to the ECA report, in 2020, EMSA paid installation and daily subsistence allowances to all staff members who were recruited as temporary agents immediately after their secondment to the Agency without prior verification of their entitlement to these allowances; although it does not affect the legality and regularity of the budgetary transactions in the 2020 financial year, in reality this represents an internal control weakness;

Draft opinion Paragraph 5 a (new) 5 a. Salutes the Agency’s quick adaptation to the Covid-19 crisis and the fact that it was able to continue providing its stakeholders with the range and quality of services they expect;

Draft opinion Paragraph 5 a (new) 5 a. Welcomes EMSA's new policy on relations with potential lobbyists and hopes it will be fully implemented in 2021.

Draft opinion Paragraph 5 b (new) 5 b. Calls on the Agency to further strengthen its cooperation with EFCA and Frontex on coast guard functions, in particular through the further reinforcement of EMSA Integrated Maritime Services offered by the Agency to EFCA and continuation of RPAS services offered to Frontex;

Draft opinion Paragraph 2 2. Notes that the Agency executed EUR 79,15 million in current year commitment appropriations representing 98,9 % of the total budget of the year and EUR 77,98 million in current year payment appropriations (96,1 % of the total budget); notes that 1,78 % of payment appropriations were cancelled, thereby complying with the target of less than 5 % cancellation set by the Commission; welcomes furthermore the improvement concerning the number of payments done out of the prescribed timeframes, which has declined1a _________________ 1aECA annual report on EU agencies for the financial year 2020, p. 133

Draft opinion Paragraph 3 3. Welcomes the Agency’s 2020-2024 strategy that will enable it to fulfil its maritime surveillance, safety and security tasks while contributing efficiently to the Union’s digital and environmental priorities; welcomes in particular the Agency’s drafting - with the European Environment Agency - of the first European Maritime Transport Environmental Report, collecting verified information on the environmental footprint of shipping activities; commends the Agency's continued enhancement of the THETIS-MRV system and stresses the importance of giving EMSA the necessary powers and resources to monitor emission reporting from vessels. Points out, moreover, that with additional capacity the Agency could play an even more important role in mitigating sectorial greenhouse gas emissions as well as other shipping-related environmental risks, including fulfilling the expected tasks in the field of response to marine pollution caused by ships and oil and gas installations;

Draft opinion Paragraph 3 a (new) 3 a. Welcomes the fact that the Agency’s role in helping to assess and verify the implementation of EU maritime security legislation has increased over the years, in step with the demand for support to the Commission and the EFTA Surveillance Authority, which is expected to continue upwards, reflecting the growing priority at EU level;

Draft opinion Paragraph 3 a (new) 3 a. Welcomes the rapid expansion of the Copernicus Maritime Surveillance Services, both in terms of the number of organisations served and earth surveillance products delivered;

Draft opinion Paragraph 3 c (new) 3 c. Welcomes the Agency´s assistance for the Commission and the Member States to advance the simplification, harmonisation and rationalisation of reporting formalities;

Draft opinion Paragraph 4 4. Welcomes the fact that for the third full year of Remotely Piloted Aircrafts Services (RPAS) operations offered by EMSA, the Agency increased its RPAS services to 944 operational days (1 372 flight hours) in the scope of coast guard functions and supporting the Member States and EU agencies in maritime surveillance operations; welcomes the use of RPAS operations in marine pollution and ship emissions monitoring. Notes the concerns over the Agency’s maritime surveillance complicity in fundamental rights violations at the border in a number of Member States.

Draft opinion Paragraph 4 a (new) 4 a. Welcomes that for the second year in a row, EMSA gathered data on the CO2 emissions from ships of over 5000 GT operating in EU waters and made this information public in June 2020 for 12000 ships thanks to the THETIS-MRV system managed by the Agency;
