Támogatom az irányelv módosítását, mert az azbeszt rendkívül veszélyes rákkeltő anyag, amely még mindig különféle gazdasági ágazatokat érint, így például az épületfelújítást, a bányászatot és kőfejtést, a hulladékgazdálkodást és a tűzoltást, amely ágazatokban a munkavállalók nagy mértékben ki vannak téve az expozíció kockázatának.A tagállamokban a foglalkozási eredetű rákos megbetegedések mintegy 78%-át az azbesztexpozícióval kapcsolatosnak ismerik el. A levegőben lévő azbesztrostok belélegezve súlyos betegségekhez, így például tüdőrákhoz vezethetnek, és a betegség első jelei az expozíció pillanatától számítva átlagosan 30 év elteltével mutatkozhatnak meg, végső soron munkával összefüggő halálesetekhez vezetve.Bár az azbesztet minden formájában betiltották az Unióban, a tilalom előtt épült épületekben továbbra is jelen van, ami - ha az épületben található azbeszttartalmú anyagokat megbontják - megbetegedéshez vezethet. Ezért az épületkorszerűsítési programok keretében alapvető fontosságú, hogy az azbeszttartalmú anyagok biztonságos eltávolítása és ártalmatlanítása elsőbbséget élvezzen.Ki kell hangsúlyozni, hogy mivel Ukrajna 2017-ig nem tiltotta be az azbeszt használatát, az ország közelgő újjáépítése jelentős kockázatot jelent a munkavállalók, különösen a törmelékeket kezelők számára. Fontos tehát, hogy az uniós munkáltatók a harmadik országokban végzett újjáépítési tevékenységek során megfelelő módon figyelembe vegyék a munkavállalókat érintő azbesztexpozíciós kockázatokat.

Segregation and discrimination of Roma children in education (B9-0394/2023)

Sajnálatos, hogy ilyen ígéretes témában ilyen hiányos állásfoglalás került elfogadásra az EP részéről. Komplex téma, mely komplex megoldásokat igényel, ugyanis az oktatási szegregáció alapjaiban véve összefügg a földrajzi és területi szegregációval, ez az állásfoglalás azonban külön kezeli a kérdést, így nem tud megfelelő megoldásokat kínálni.Elfogadhatatlan, hogy az állásfoglalás kettős mérce alapján bizonyos tagállamokat elítél, míg másokat, ahol szintén aggasztó a helyzet meg sem említ. Olyan tagállamok, mint Magyarország a Bizottság által is elismert kiemelkedő eredményeket értek el az elmúlt 10 évben. Olyan intézkedésekkel segíti a felzárkóztatást és a szegénységből való kilépést, mint a 3 éves kortól való óvodai kötelezettség, felzárkóztató- és ösztöndíj-programok, roma szakkollégiumok és szakmai továbbképző programok bevezetése, amelyek hozzájárulnak a szegregált osztályok számának csökkentéséhez.Aggasztó, hogy az EP baloldali többsége és az EPP látszólag nem tartja fontosnak a pénzügyi átláthatóságot. Hiszen a rendelkezés, mely felhívná a Bizottságot arra, hogy megvizsgálja az elmúlt 10 évben elköltött oktatási források hogyan hasznosultak, mely tagállamokban nem is hívtak le forrásokat a roma integrációra, illetve mely tagállamokban éltek ezzel vissza, nem került bele az állásfoglalásba.Az EP állásfoglalása egyértelmű visszalépést jelent az uniós roma oktatáspolitikában a 2011-ben a soros magyar elnökség alatt elfogadott uniós roma stratégia kezdeményezéseihez képest. Ezért a szavazás során tartózkodtam.

Harmonising the rights of autistic persons (B9-0390/2023)

Az autista emberek jogainak harmonizációjával foglalkozó állásfoglalási indítvány számos fontos és helytálló gondolatot fogalmaz meg. Például hangsúlyozza, hogy évekbe telhet az autizmus diagnosztizálása, ami a kezelés késlekedését vonja maga után, és ez akár a betegek élettartamának csökkenését is eredményezheti.A helyzetet tovább súlyosbítja, hogy az autistáknak sokszor nincs fogyatékossági igazolványuk, és ha van is, a nemzeti igazolványokat nem mindig ismerik el uniós szinten. Az előterjesztés ezért hasznosnak tartaná egy Európai Fogyatékossági Kártya létrehozását olyan személyek számára is, akik nem látható fogyatékossággal (például autizmussal) küzdenek. Az állásfoglalási indítvány felhív az autista személyek körében tapasztalható magas munkanélküliség elleni küzdelemre, a társadalmi tudatosság növelésére.Az említett rendkívül fontos gondolatok fényében különösen sajnálatos, hogy még ebben az előterjesztésben is sikerült megjelentetni olyan nem ideillő ideológiai kérdéseket (LGBTIQ+ jogok, interszekcionalizums, isztambuli egyeztmény), melyek megosztóak, és elterelik a figyelmet az alapkérdésről - az autista személyek jogainak védelméről és kiteljesítéséről.Ezért az állásfoglalási indítvány plenáris szavazásán tartózkodó álláspontot voltam kénytelen képviselni.

Standardised dimensions for carry-on luggage (B9-0391/2023)

Az Európai Parlament állásfoglalási indítványa a kézipoggyászok szabványosított méreteiről.Köztudott, hogy a légitársaságok eltérő szabályokat és korlátozásokat alkalmaznak a fedélzeti poggyászok méretét és súlyát illetően, ami gyakran vezet zavarokhoz, kényelmetlenségekhez, esetenként vitákhoz az utasok és a légitársaságok személyzete között.A helyzetet tovább súlyosbítja, hogy a poggyászhoz kapcsolódó rejtett és többletköltségek nehezítik a különböző légitársaságok ajánlatai összehasonlításának lehetőségét.Ezért erősítené az átláthatóságot és a fogyasztóvédelmet, ha a kézipoggyász méretét, súlyát és típusát uniós szinten harmonizálnák az Unióban működő valamennyi légitársaságra alkalmazva.Fontosnak tartom a fogyasztók, jelen esetben a légiutasok, hatékony védelmét, ezért az állásfoglalási indítványt támogattam az októberi strasbourgi plenáris szavazáson.

System of own resources of the European Union (A9-0295/2023 - José Manuel Fernandes, Valérie Hayer)

A Fidesz európai parlamenti képviselőcsoportja nem támogatja a tagállami hatáskörbe tartozó saját forrás határozat EP jelentés által javasolt módosítását. Az uniós költségvetési bevételeket meghatározó saját források bevezetéséről, az ezeket szabályozó saját forrás határozatról kizárólag a Tanács dönthet, amely döntést egyhangúsággal kell meghoznia és a nemzeti parlamenteknek is meg kell erősítenie. Az Európai Parlamentnek a konzultáción kívül semmilyen jogköre nincs ebben az eljárásban. Ehhez képest az EP jelentés javaslatai túlterjeszkedőek, sértik a tagállamok szuverenitását. A Fidesz európai parlamenti képviselőcsoportja ezért elutasította az EP jelentését.

Effectiveness of the EU sanctions on Russia (RC-B9-0453/2023, B9-0453/2023, B9-0454/2023, B9-0455/2023, B9-0456/2023, B9-0457/2023)

Ahogyan azt a határozat szövege is megállapítja, a szankciós politika nincsen hatással az orosz politika irányára és tartalmára, s többet árthat az Európai Uniónak és tagállamainak, mint a szankciók alá vont Oroszország gazdaságának. Ezért a szankciókat nem tartjuk a háborús konfliktusra adott hatékony válaszlépésnek. Elfogadhatatlanok a javaslatként megfogalmazott újabb energiaszankciók, így az orosz kőolaj és földgáz teljes embargója, ahogyan elfogadhatatlan az orosz energiacégekkel és a Roszatommal való együttműködés teljeskörű felszámolása, valamint az orosz nukleáris fűtőanyagok és technológia behozatalának tilalma is. Ezért a Fidesz európai parlamenti képviselőiként az állásfoglalási indítványt nem támogattuk.

EU framework for the social and professional situation of artists and workers in the cultural and creative sectors (A9-0304/2023 - Antonius Manders, Domènec Ruiz Devesa)

A Covid19-válság idején a kulturális és kreatív szektor sokat szenvedett, a művészek többsége váltani kényszerült és más munkát keresett. A jelentés célja, hogy uniós keretet hozzon létre a művészek és más szakemberek számára a kulturális és kreatív szektorban, annak érdekében, hogy tisztességes munkakörülményeket biztosítson a művészek és más kulturális és kreatív szakemberek számára, továbbá megkönnyítse a művészi kompetenciák, kreatív készségek és képesítések automatikus kölcsönös elismerését, amelynek jelenlegi hiánya akadályozza ezen szakemberek határokon átnyúló mobilitását. Ezek a célok támogatásra méltók.Azonban az Unió által finanszírozott programok és projektek szociális feltételrendszerének bevezetése a erősen gátolhatja a Kreatív Európa programban való részvételt. Továbbá az irányelv megalkotása iránti kérelem (a jelentéstervezetben javasolt határozat helyett) túlzó, mert alacsonyabb szinten is elegendő szabályozni. A fentiek miatt tartózkodtam a szavazáskor.

Reducing inequalities and promoting social inclusion in times of crisis for children and their families (A9-0360/2023 - Sandra Pereira)

A jelentés célként tűzi ki azt, ami Magyarországon már hosszú évek óta valóság: ingyenes és 3 éves kortól kötelező az óvoda, ingyenes az általános iskola, ideértve minden tankönyvet is! A rászoruló gyermekek számára ingyenes vagy kedvezményes az óvodai és iskolai étkezés. Továbbá Magyarországon minden gyermek számára ingyenes az egészségügyi ellátás.Ugyanakkor a gyermekeket nem lehet elszigetelten szemlélni: családban élnek, ezért a teljes családot támogatjuk: gyermektámogatási és családpolitikánk széles körű támogatásokkal (az adókedvezményektől a vissza nem térítendő támogatásokig) segíti az otthonteremtést, támogatja az éppen házasságot kötő, vagy babát váró fiatalokat éppúgy, mint a nagycsaládosokat.Mivel pedig a gyermekszegénység összefügg a szülők helyzetével, az a legfontosabb, hogy a szülők munkához jussanak: ha munka van, minden van. Magyarországon a foglalkoztatási ráta csaknem 75%-os, míg a munkanélküliség mindössze 3,9%. A 4,75 millió foglalkoztatott közül csupán 250 ezer ember kap minimálbért, amelynek összege idén 15%-kal emelkedik meg. A szakképzettek minimálbérét az ún. garantált bérminimumot 700 ezer ember kapja, ennek összege is 10%-kal lett magasabb idén.Sajnos azonban néhány, a témához nem illő baloldali ideológiai elemet is a jelentésbe erőltettek, ami miatt tartózkodni kényszerültem a szavazáskor.

Children first - strengthening the Child guarantee, two years on from its adoption (B9-0462/2023)

A gyermekszegénység növekedése az EU egyes tagállamaiban, a háborús infláció miatt komoly probléma, amely ellen tenni kell, ennek jó eszköze az Európai Gyermekgarancia. Az étkezéshez, az oktatáshoz és az egészségügyi ellátáshoz való hozzáférés minden gyermek számára alapvető.Magyarországon ingyenes az óvoda, ingyenes az iskola, ideértve minden tankönyvet is! A rászoruló gyermekek számára ingyenes vagy kedvezményes az óvodai és iskolai étkezés. Továbbá Magyarországon minden gyermek számára ingyenes az egészségügyi ellátás.Ugyanakkor az Európai Gyermekgarancia finanszírozására kért többlet költségvetés egyes tagállamokra túlzott terhet róhat, amikor az embereket EU-szerte elsősorban a megélhetési költségek aggasztják. A fentiek miatt tartózkodtam az indítványról történő szavazáskor.

Implementation of the European Solidarity Corps programme 2021-2027 (A9-0308/2023 - Michaela Šojdrová)

A jelentés az Európai Szolidaritási Testület program végrehajtását vizsgálja a jelenlegi, 2021–2027-es többéves pénzügyi keretben, és a 2021–2023-as éveket öleli fel. A jelenlegi önálló program az EU kiemelt önkéntességi programja. Üdvözlendő, hogy a program célja az, hogy új lehetőségeket nyisson meg a fiatalok előtt a szolidaritással kapcsolatos területeken végzett önkéntes tevékenységekre, valamint szolidaritási projektek kidolgozására és fejlesztésére. A jelentésben szereplő speciális vízum létrehozására irányuló felhívás viszont aggályos, ezért a Fidesz EP delegációja tartózkodott a jelentés ilyen formájú elfogadása helyett.

The Union, including Member States and the Union’s institutions within the meaning of Article 13 TEU, is founded on the values of respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights, including the rights of persons belonging to minorities. These values are common to the Member States in a society in which pluralism, non- discrimination, tolerance, justice, solidarity and equality between women and men prevail. These values define the very identity of the European Union as a common legal order inspired by the Member States’ constitutional heritage.

(8) Having regard to the substantive criterion applicable to the distribution between the Court of Justice and the General Court of jurisdiction to give preliminary rulings, it is necessary, for reasons of legal certainty and expedition, for the referring courts not themselves to decide the question as to which of the Courts of the Union has jurisdiction to hear and determine a request for a preliminary ruling. Every request for a preliminary ruling must therefore be submitted to a single court, namely the Court of Justice, which will determine, in accordance with detailed rules to be set out in its Rules of Procedure, whether the request falls exclusively within one or several specific defined areas laid down in the Statute of the Court of Justice of the European Union and, accordingly, whether that request must be dealt with by the General Court. The Court of Justice will continue to have jurisdiction to adjudicate on requests for a preliminary ruling that, notwithstanding that they may be connected to those specific areas, also concern other areas, since the first subparagraph ofThe principle of legal certainty and speed demands that there is a clear division of jurisdiction between the Court of Justice and the General Court. In accordance with the provisions of Article 2 of this Regulation, the areas defined in Article 256(3)50b of the Treaty on the Functioning of the European Union does not provide any possibility of transferring to the General Court jurisdiction to give preliminary rulings in areas other than the specific areasStatute shall be handled by the Court of Justice.

(48) Member States should ensure adequate enforcement of the transparency obligations applicable to political advertising laid down in this Regulation. Member States should entrust competent authorities with the necessary powers to supervise compliance with those transparency obligations. In order to avoid undue interferences, such national regulatory authorities or bodies should exercise their powers impartially and transparently and be legally distinct from the government and functionally independent of their respective governments and of any other public or private body. Citizens and other interested parties should be able to know which regulatory authorities are competent in each Member State, which should be achieved by providing an obligation for the Authority to publish on its website and keep updated a list of Member States’ national regulatory authorities. Decisions of national regulatory authorities should be subject to effective legal remedies, in full compliance with Article 47 of the Charter. Title XIII a (new) – rule 237 a (new)
Rule 237a Extraordinary measures 1. This Rule applies to situations in which the European Parliament, due to exceptional and unforeseeable circumstances beyond its control, is hindered from carrying out its duties and exercising its prerogatives under the, and according to the Treaties and a temporary derogation from Parliament’s usual procedures set out elsewhere in these Rules is necessary in order to adopt extraordinary measures to enable it to continue to carry out those duties and to exercise those prerogatives. Such extraordinary circumstances shall be considered to exist where the President comes to the conclusion, on the basis of reliable evidence confirmed, where appropriate, by the services responsible for security and safety, the Legal Service of the European Parliament and after consultation with the President of the European Commission and the President of the Council of the European Union, that for reasons of security or safety or as a result of the non-availability of technical means it is or will be impossible or dangerous for Parliament to convene in accordance with its usual procedures as set out elsewhere in these Rules and its adopted calendar. 2. Where the conditions set out in paragraph 1 are fulfilled, the President may decide, with the agreement of the Conference of Presidents and after consultation with the Quaestors, to apply one or more of the measures referred to in paragraph 3. If it is impossible, due to reasons of imperative urgency, for the Conference of Presidents to convene, the President may decide to apply one or more of the measures set out in paragraph 3, points (a), (b) and (c). Such a decision shall lapse five days after its adoption unless approved by the Conference of Presidents within that deadline. The Conference of Presidents shall consult with the Quaestors before its decision. Following a decision by the President, approved by the Conference of Presidents, a political group or Members whose rights stemming from their parliamentary mandate are affected by the decision may, at any time, request that some or all of the measures addressed by that decision be submitted individually to Parliament for approval without debate. The vote in plenary shall be placed on the agenda of the first sitting following the day on which the request was tabled. If a measure fails to obtain a majority of the votes cast, it shall lapse after the announcement of the result of the vote. A measure approved by the plenary may not be the subject of a further vote during the same part-session. 3. The decisions referred to in paragraph 2 shall include the following, exhaustive list of measures: (a) postponement of a scheduled part- session, sitting or meeting of a committee to a later date and/or cancellation or limitation of meetings of inter- parliamentary delegations and other bodies; (b) displacement of the part-session, sitting or meeting of a committee from Parliament’s seat to one of its working places or to an external place or from one of its working places to Parliament’s seat, to one of Parliament’s other working places or to an external place; (c) holding of the part-session or the sitting on the premises of Parliament but fully or partially in separate meeting rooms allowing for appropriate physical distancing; (d) holding of the part session, sitting or meeting of bodies of Parliament under the remote participation regime laid down in Rule 237c; (e) in the event that the ad hoc replacement mechanism laid down in Rule 209(7) fails to provide sufficient remedies to the extraordinary circumstances under consideration, temporary replacement by political groups of Members in a committee unless the Member concerned opposes; (f) the definition of presence in the Chamber and its legal consequences such as rules related to the establishment of quorum and threshold. 4. A decision referred to in paragraph 2 shall be limited in time and scope, shall state the reasons on which it is based and might be subject to the procedure laid down in Article 263 of the TFEU. It shall enter into force upon its publication on Parliament’s website or, if circumstances prevent such publication, by the best available means. All Members shall also be informed individually of the decision without delay. The decision may be renewed by the President in accordance with the procedure under paragraph 2 once or more for a limited time. A decision to renew shall state the reasons on which it is based and might be subject to the procedure laid down in Article 263 of the TFEU. The President shall revoke a decision adopted under this Rule as soon as the extraordinary circumstances referred to in paragraph 1 that gave rise to its adoption have disappeared. 5. This Rule shall be applied only as a last resort, and only measures that are strictly necessary to address the extraordinary circumstances under consideration shall be selected and applied. When applying this Rule, due account shall be taken, in particular, of the principle of representative democracy and of the rule of law, the principle of equal treatment of Members, the right of Members to exercise their parliamentary mandate without impairment, providing proportional and balanced political representation, their right to speak in one of the official languages of the European Union and to vote freely, individually and in person. Compliance with Protocol No 6 to the Treaties needs to be ensured, and, if derogation is necessary with regards to the extraordinary circumstances referred to in this Rule, the formal agreement of the Member States shall be required, in accordance with the Treaties.

Rule 237b Disturbance of the political balance in Parliament 1. The President may, with the agreement of the Conference of Presidents, adopt the necessary measures in order to facilitate participation of Members or a political group concerned if, on the basis of reliable evidence, the President comes to the conclusion that the political balance in Parliament resulting from the election is severely impaired because a significant number of Members or a political group cannot take part in Parliament’s proceedings in accordance with its usual procedures as set out elsewhere in these Rules, for reasons of security or safety or as a result of the non- availability of technical means. The sole aim of such measures shall be to allow the remote participation of Members concerned by the application of selected technical means under Rule 237c(1) or by other appropriate means serving the same purpose. 2. Measures under paragraph 1 may be adopted for the benefit of a significant number of Members if exceptional and unforeseeable circumstances beyond their control occurring in a regional context lead to their non-participation. Measures under paragraph 1 may also be adopted for the benefit of members of a political group if that group has requested them where the non-participation of a group results from exceptional and unforeseeable circumstances beyond the control of that group. 3. Rule 237a(2), second and third subparagraphs, and the rules and principles laid down in Rule 237a(4) and (5) shall apply accordingly.

Rule 237c Remote participation regime 1. Where the President decides under Rule 237a(2), to apply the remote participation regime by adopting a measure under Rule 237a(3), point (d), Parliament may conduct its proceedings remotely inter alia by permitting all Members to exercise certain of their parliamentary rights by electronic means. Where the President decides in accordance with Rule 237b that selected technical means under the remote participation regime are to be used, this Rule shall apply only to the necessary extent and only to the Members concerned. 2. The remote participation regime shall ensure that : – Members are able to exercise their parliamentary mandate, including, in particular, their right to speak in plenary and in the committees, to vote and to table texts, without impairment; – all votes are cast by Members individually and in person; – the remote voting system enables Members to cast ordinary votes, roll call votes and secret ballots; – a uniform voting system is applied for all Members, whether present or not on Parliament’s premises; – translation and interpretation services are provided to the greatest possible extent; – the information technology solutions made available to Members and their staff are ‘technology neutral’; – participation of Members in parliamentary debates and votes takes place using secure electronic means that are managed and supervised by Parliament’s services. At the same time, this amendment derogates from Rule 178 and explicitly allows the remote voting system to be used to check the quorum; 3. When taking the decision referred to in paragraph 1, the President shall determine whether that regime applies to the exercise of Members’ rights in plenary only, or also to the exercise of Members’ rights in Parliament’s committees and/or other bodies. The President shall also determine in his or her decision how rights and practices which cannot be exercised appropriately without the Members’ physical presence are adapted for the duration of the regime. These rights and practices concern, inter alia: – the manner in which attendance at a sitting or meeting is counted; – the conditions under which a request for a check of the quorum is made, – the tabling of texts; – the presentation of, and the objection to, oral amendments; – the order of votes; – the deadlines and time limits for the setting of the agenda and for procedural motions. 4. For the purposes of the application of the provisions of the Rules relating to quorum and voting in the Chamber, Members who are participating remotely shall be deemed to be physically present in the Chamber. By way of derogation from Rule 171(11), Members who have not spoken in a debate may, three times per sitting, hand in a written statement, which shall be appended to the verbatim report of the debate. The President shall, where necessary, determine the manner in which the Chamber may be used by Members during the application of the remote participation regime, and in particular the maximum number of Members who can be physically present. 5. Where the President decides in accordance with paragraph 3, first subparagraph, to apply the remote participation regime to committees or other bodies, paragraph 4, first subparagraph, shall apply, mutatis mutandis. 6. The Bureau shall adopt measures concerning the operation and security of the electronic means used under this Rule, in accordance with the requirements and standards laid down in paragraph 2 and after consultation with the Quaestors. 7. Parliament’s competent bodies shall take all measures, including financial measures, necessary to ensure the availability of state-of-the-art technology and optimal conditions for the effective implementation of Rules 237a to 237d.

During the period of validity of a decision adopted under Rule 237a(2), the parliamentary business conducted in part- sessions and committee meetings shall be limited to the consideration and adoption of measures identified as essential and urgent by the Conference of Presidents taking into account the opinion of the Conference of Committee Chairs in accordance with paragraph 1. 3. Within two months after the adoption or modification of the rules regarding extraordinary circumstances under Title XIIIa, the President of the European Parliament shall initiate the procedure of Article 263 TFEU to review the legality of the modification of the Rules of Procedure and ensure that the modification is in line with the principle of the rule of law and democracy.

Article 8a IPI measures 1. Where the Commission finds, following an investigation and consultations pursuant to Article 6, that a third-country measure or practice exists, it may, if it considers it to be in the interest of the Union, impose an IPI measure by means of an implementing act. An IPI measure shall only apply if the main object of the procurement procedure falls within the scope of the implementing act, as specified in accordance with paragraph 7 (a). The procurement procedure shall not be designed with the intention of excluding it from the scope of this Regulation. 2. The IPI measure shall be determined on the basis of the following criteria, in light of available information and the Union’s interest: (a) the proportionality of the IPI measure regarding the third-country measure or practice; (b) the availability of alternative sources of supply for the goods and services concerned, in order to avoid or minimise a significant negative impact on contracting authorities or contracting entities. 3. The IPI measure shall only apply to procurement procedures with an estimated value of at least EUR 15 000 000 net of value-added tax for works and concessions, and of at least EUR 5 000 000 net of value-added tax for goods and services. 4. The IPI measure shall also apply in the case of specific contracts awarded under a dynamic purchasing system, when those dynamic purchasing systems were subject to the IPI measure, with the exception of specific contracts the estimated value of which is below the respective values set out in Article 8 of Directive 2014/23/EU, Article 4 of Directive 2014/24/EU and Article 15 of Directive 2014/25/EU. The IPI measure shall not apply to procedures for the award of contracts based on a framework agreement. The IPI measure shall also not apply to individual lots to be awarded according to Article 5 (10) of Directive 2014/24/EU or Article16 (10) of Directive 2014/25/EU. 5. In its implementing act, the Commission may decide, within the scope defined in paragraph 6 of this Article, to restrict the access of operators, goods or services from third countries to procurement procedures by requiring contracting authorities or contracting entities to: (a) impose a score adjustment measure on tenders submitted by economic operators originating in the that third country; or (b) exclude tenders submitted by economic operators originating in that third country; or (c) impose a combination of (a) and (b), if different sectors or categories of goods and services are subject to IPI measures.; 6. The score adjustment measure referred to in paragraph 5(a) shall apply only for the purpose of the evaluation and ranking of the tenders. It shall not affect the price due to be paid under the contract to be concluded with the successful tenderer. 7. The implementing act, adopted in accordance with Article 14(2), shall specify the scope of application of the IPI measure, including: (a) the sectors or the categories of goods, services and concessions based on the Common Procurement Vocabulary set out in Regulation (EC) No 2195/20021a as well as any applicable exceptions, (b) specific categories of contracting authorities or contracting entities; (c) specific categories of economic operators; (d) specific thresholds equal or above those set out in paragraph 3; (e) as regards the score adjustment measure referred to in paragraph 5(a), the percentage value of the adjustment shall be set up to 40% of the evaluation score of the tender depending on the third country and sector of goods, services, works or concessions envisaged. 8. The Commission shall impose an IPI measure in form of exclusion, according to paragraph 5(b), only when the third-country measure or practice is sufficiently severe and the potential negative impact due to the limited availability of alternative sources, as provided for in paragraph 2(b), is comparatively small. 9. The Commission may withdraw the IPI measure or suspend its application if the third country takes satisfactory corrective actions or undertakes commitments to end the measure or practice in question. If the Commission considers that the corrective actions or commitments undertaken have been rescinded, suspended or improperly implemented, it shall make its findings publicly available and may reinstate the application of the IPI measure at any time. The Commission may withdraw, suspend or reinstate an IPI measure in accordance with the examination procedure referred to in Article 14(2) and followed by the publication of a notice in the Official Journal of the European Union. 10. An IPI measure shall expire five years from its entry into force or its extension, unless a review shows a need for its continued application. Such a review shall be initiated by a publication of a notice in the Official Journal of the European Union, at the initiative of the Commission nine months before the date of expiry, and shall be concluded within six months. Article 9a Additional contractual obligations upon the successful tenderer 1. In the case of procurement procedures to which an IPI measure is applicable, as well as in the case of contracts awarded based on a framework agreement where the estimated value of those contracts is equal or above the values set out in Article 8 of Directive 2014/23/EU, Article 4 of Directive 2014/24/EU and Article 15 of Directive 2014/25/EU, respectively, and where those framework agreements were subject to the IPI measure, contracting authorities and contracting entities shall also include, among the conditions of the contract with the successful tenderer: (a) a commitment not to subcontract more than 50% of the total value of the contract to economic operators originating in a third country which is subject to an IPI measure; (b) for contracts whose subject matter covers the supply of goods, a commitment that, for the duration of the contract, goods supplied and/or services provided in the execution of the contract and originating in a third country which is subject to the IPI measure represent no more than 50% of the total value of the contract, whether such goods and/or services are supplied or provided directly by the tenderer or by a subcontractor; (c) an obligation to provide, upon request, adequate evidence corresponding to points (a) and/or (b) to the contracting authority or the contracting entity at the latest upon completion of the execution of the contract; (d) a proportionate charge, in case of non-observance of the commitments referred in points (a) or (b) between 10% and 30% of the total value of the contract. 2. For the purposes of paragraph 1 point (c), it is sufficient to provide evidence that more than 50% of the total value of the contract originates in countries other than the third country subject to the IPI measure. The contracting authority or contracting entity shall request evidence in case of reasonable indications of non-compliance with points (a) or (b) of paragraph 1 or if the contract is awarded to a group of economic operators comprising a legal person originating in a third country subject to an IPI measure. 3. Contracting authorities and contracting entities shall include a reference to the additional conditions laid down in this Article in the documents for procurement procedures to which an IPI measure is applicable.
