Recital 20

(20) Engines which are in compliance with and covered by the scope of the new rules on emission limits and EU type-approval procedures should be permitted to be placed on the market in the Member States; those engines should not be subject to any other national emission requirement. Member State granting approvals should take ~~the necessary verification measures in order to ensure the identification of engines produced under each~~verification and control measures where circumstances so require for the import and supply of engines on the EU market, so as to ensure that they conform to EU type- approval requirements in each case.

This shall be without prejudice to the right of Member States to encourage or restrict the use of engines placed on the market, provided that the methods chosen are not discriminatory and are objectively justified.

(20c) Manufacturers or their accredited representatives should provide a certificate of conformity for each engine corresponding to the approved engine type. Where importers or distributors introduce products on the market under their own name, they should have sufficient information regarding design and manufacture, since they will assume legal responsibility on affixing the CE marking and issuing the certificate of conformity. The issuing of certificates of conformity is compulsory for all products entering the EU market, since non- certified products might affect human life, health or safety, as well as endangering the environment.

Recital 25

(25) As a consequence, UNECE regulations and the amendments thereto which the Union has voted in favour of or to which the Union has acceded, in application of Decision 97/836/EC, should be recognized as equivalent to EU type- approvals granted under this Regulation. Accordingly, in order to align this Regulation as close as possible to agreed UNECE texts, the Commission should be empowered to adopt delegated acts in order to determine which UNECE regulations will apply to EU type- approvals.

(29) With a view to taking into account on- going technical progress and the latest findings in the fields of research and innovation and the health protection of users who are particularly at risk, it is appropriate to identify further pollutant emission reduction potential of engines installed in non-road mobile machinery. The focus of these assessments should be on those engine categories that are included for the first time in the scope of this Regulation and on those for which emission limit values remain unaltered under this Regulation. The Commission should therefore put forward a proposal concerning hand-held machinery with engines in categories NRSh and NRS which lays down, in accordance with the state of the art, limit values for carbon monoxide, hydrocarbons (HCs), benzol and nitrogen oxides (NOx) and durability periods which properly reflect the conditions under which these engines are used in a professional context.

1. The manufacturer, in its capacity as the holder of an engine type or engine family EU type-approval, or an accredited representative, before placing the product on the market, shall deliver a certificate of conformity to accompany each engine which is manufactured in conformity with the approved engine type. If importers or distributors place products on the market under their own name, they shall assume the responsibilities of the manufacturer with respect to type-approval. Such responsibilities shall be assumed by any accredited natural or legal persons that assemble, package or labels products to be placed on the market and/or put into service under their own name. In this case, importers or distributors must have sufficient information regarding product design and manufacture.

Notwithstanding the requirements of Article 5(2) and (3) and Article 17(2), Member States shall permit the placing on the market of replacement engines that meet one of the following requirements: (a) engines of category NRE, NRG or NRS that comply with the limit values that the engine which is intended to be replaced had to meet when originally placed on the market; (b) engines of category RLL or RLR that comply with the limit values that the engine which is intended to be replaced had to meet when originally placed on the market, if the engine to be replaced was manufactured on or after 1 January 2012; (c) engines of category RLL or RLR that comply with the limit values that applied to engines within the scope of the respective category on 31 December 2011 for placing on the market if the engine to be replaced was produced on or before that date and the use of a replacement engine that meets the requirements of the latest applicable emissions stage in the railcar or locomotive in question will involve significant technical difficulties.

It operates on tyres, crawlers or with other mobile arrangements. In fixed positions it may be supported by outriggers or other accessories increasing its stability. The superstructure of a mobile crane may be of the type of full- circle slewing, of limited slewing or non- slewing. It is normally equipped with one or more hoists and/or hydraulic cylinders for lifting and lowering the jib and the load. Mobile cranes are equipped either with telescopic jibs, with articulated jibs, with lattice jibs, or a combination of these, of a design such that they may readily be lowered. The loads suspended from the jib may be handled by hook block assemblies or other load-lifting attachments for special services;

The following shall apply with regard to the granting of a request pursuant to the first subparagraph: (1) A technical inspection body or licensed service shall certify, with reference to the relevant rules laid down by UNECE Regulation 132 (REC), the US Environmental Protection Agency (EPA), the Californian CARB department or VERT (Retrofit Association), that retrofitting a particle filter system is not possible for technical reasons linked to the engine or replacement parts, or that this would impair the original performance of the mobile machinery to such an extent that the normal use for which it was placed on the market would no longer be possible. (2) Certificates pursuant to point 1 above shall be forwarded to the competent authority and stored in such a way as to ensure that they can be produced during a check carried out at the place of use. (3) Operators of replacement engines shall be obliged to have the basic functioning of the particle filter system checked by a licensed service at least once a year. A visual inspection of the inside of the exhaust pipe and of the exhaust emissions when the engine is started or the use of a simple hand-held measuring device shall generally suffice for this purpose.

Applicants shall submit the following together with their applications : – documents detailing, for each engine, the technical difficulties involved in replacing the original engine with an engine that meets the requirements of a later EU emissions stage; – environmental and health impact studies on emissions of atmospheric pollutants resulting from the use of a replacement engine that does not comply with current EU standards, The words ‘replacement engine’, together with the unique reference for the derogation, shall be marked on engines covered by this paragraph.

An accredited in-house technical service shall meet the following requirements: (a) in addition to being designated by the approval authority of a Member State it shall be accredited by a national accreditation body as defined in point 11 of Article 2 of Regulation (EC) No 765/2008 and in accordance with the standards and procedure referred to in Article 47 of this Regulation; (b) the accredited in-house technical service and its personnel shall be organisationally identifiable and have reporting methods within the undertaking of which they form part which ensure their impartiality and demonstrate it to the relevant national accreditation body; (c) neither the accredited in-house technical service nor its personnel shall engage in any activity that might conflict with their independence of judgment or integrity in relation to the categories of activities for which they have been designated; (d) the accredited in-house technical service shall supply its services exclusively to the undertaking of which it forms part. 3. An accredited in-house technical service need not be notified to the Commission for the purposes of Article 49, but information concerning its accreditation shall be given by the undertaking of which it forms part or by the national accreditation body to the designating approval authority at the request of that authority. 4. The Commission shall be empowered to adopt delegated acts in accordance with Article 55 laying down the technical requirements for which self-testing is allowed, as referred to in paragraph 1. Subject to the entry into force of the implementing measures to this Regulation, Member States may make provision for financial incentives that apply to the retrofitting of in-use engines which do comply with this Regulation in order to meet the emission limit values set out in the Annex applicable to the type of engine to be retrofitted. 2. For each type of engine, the financial incentives referred to in paragraph 1 shall not exceed the additional cost of the technical devices used to ensure compliance with the emission limits specified in the respective Annex, including the cost of installation on the engine.

(1) The internal market comprises an area without internal frontiers in which the free movement of goods, persons, services and capital must be ensured. To this end measures for the reduction of air pollution by engines to be installed in non-road mobile machinery were established by Directive 97/68/EC of the European Parliament and of the Council11. (4) Regulation (EU) No 167/2013 of the European Parliament and of the Council12 has already established a regulatory framework for the approval and market surveillance of agricultural and forestry vehicles. Owing to the similarity of the fields and given the positive experience derived from the application of Regulation (EU) No 167/2013, many of the rights and obligations established by that Regulation shGiven that the emissions-related requirements laid down therein are based on Directive 97/68/EC, once that Directive has been repealed the Commission should, immediately after the present proposal for a regulation has been adopted, submit a proposal for a delegated act containing Stage V emission requirements in line with the current state of technology for agricultural and forestry vehicles as well. These requirements could be taken into consideration in respect of non-road machinery. (8) The Seventh General Union Environment Action Programme adopted by Decision No 1386/2013/EU of the European Parliament and of the Council13 recalls that the Union has agreed to achieve levels of air quality that do not give rise to significant negative impacts on, and risks to, human health and the environment. Union legislation has established appropriate emission limits for ambient air quality for the protection of human health and sensitive individuals in particular, as well as for national emission ceilings14. Following its Communication of 4 May 2001, which established the ‘Clean Air For Europe (CAFE) programme’, the Commission adopted another Communication on 21 September 2005 entitled ‘Thematic strategy for air pollution’. One of the conclusions of that thematic strategy is that further reductions in emissions from the transport sector (air, maritime and land transport), from households and from the energy, agricultural and industrial sectors are needed to achieve EU air quality objectives. In this context, the task of reducing emissions from engines installed in non-road mobile machinery (NRMM) should be approached as part of an overall strategy.
