Recital 7
(7) Longer and higher vehicles may be used in cross- border transport if the two Member States concerned already allow it and if the conditions for derogation under Article 4(3), (4) or (5) of the Directive are met. The European Commission has already provided guidance on the application of Article 4 of the Directive. The transport operations referred to in Article 4(4) do not have a significant impact on international competition if the cross- border use remains limited to two Member States where the existing infrastructure and the road safety requirements allow iis provision must not distort the internal market. This balances the Member States’ right under the principle of subsidiarity to decide on transport solutions suited to their specific circumstances with the need to prevent such policies from distorting the internal market. The provisions of Article 4 (4) are clarified in this respect.

Pending the adoption of the delegated acts, the vehicles or combinations of vehicles equipped with aerodynamic devices to the rear, which meet the requirements referred to in paragraph 2 and were tested in accordance with paragraph 3 may circulate if their length exceeds the length laid down in Annex I, point 1.1 by no more than two metres. This transitional measure shall apply from the date of entry into force of this Directive. At airports whose annual traffic has been not less than three million passengers for at least three consecutive years, the airport managing body shall ensure that the operations of the airport and of airport users, in particular the air carriers and the suppliers of ground handling services, are coordinated through a proper contingency plan in view of possible situations of multiple cancellations and/or delays of flights leading to a considerable number of passengers stranded at the airport, including in cases of airline insolvency or revocation of the operating licence. The Airport Managing body shall be empowered to adopt measures to enforce co-operation of air carriers and the suppliers of groundhandling services in the preparation of this contingency plan. The contingency plan shall be set up to ensure adequate information and assistance to the stranded passengers. The managing body of the airport shall communicate the contingency plan and any amendments to it to the National Enforcement Body designated pursuant to Article 16. Member States shall ensure that the National Enforcement Body will have both the capability and resources to engage effectively on this topic. At airports below the above-mentioned threshold, the airport management body shall make all reasonable efforts to coordinate airport users and to assist and inform stranded passengers in such situations.

(5) The registration of motor vehicles registered in another Member State is hampered by burdensome registration formalities in the Member States, in particular by the obligation to submit these vehicles to complementary tests in order to assess their general condition prior to registration or in order to identify them. Therefore, it is necessary to reduce these formalities in order to ensure the free movement of motor vehicles and to reduce the administrative burden for citizens, businesses and registration authorities. Especially for citizens or businesses acquiring a motor vehicle registered in another Member State, it is appropriate to provide for a simplified registration procedure that includes the recognition of documents and roadworthiness tests issued in another Member State and that would organise the administrative cooperation between the competent authorities on the exchange of missing data. Particular emphasis needs to be placed on tackling the problem of tampering with odometers, and the impact this is having on consumer confidence in cross-border trade, as well as the impact "clocking" is having on road safety.

In the event of a severe imbalance in the market for milk and milk products, the Commission may decide to grant aid to milk producers who voluntarily cut their production by at least 5% compared with the same period in the previous year, for a period of at least three months, which may be extended. 2. In preparation for the abolition of milk quotas post 2015 the following measures shall be deemed to be a cut in production, under the conditions laid down by the Commission pursuant to paragraph 4, or a form of market withdrawal. (a) the supply of milk, free of charge, to charitable organisation. (b) the transfer of milk quotas between member states by means of bilateral agreements. (c) direct exportation of milk and milk products to third countries. 3. Union support should be granted to the completion of an impact assessment to assess the viability of allowing member states to treat out-of-quota milk as the first milk production of the following market year. 4. During the period referred to in paragraph 1, subparagraph 1, the products of undertakings that have implemented this system under the arrangements provided for in that subparagraph shall be given priority when intervention measures, as referred to in Title I of Part II are taken on the market for milk and milk products. 5. Taking into account the need to ensure that this scheme is operated in an effective and appropriate manner, the Commission shall be empowered to adopt delegated acts in accordance with Article 160 to establish: (a) the amount of the aid and the size of the levy referred to in paragraph 1; (b) the criteria to be met in order to be eligible for aid; (c) the specific conditions that will trigger implementation of this scheme; (d) the terms under which free distribution of milk to charitable organisations, as referred to in paragraph 2, may be deemed a cut in production.

The protein source for the colony, the product is natural, free from additives and harvested at the entrance to the hive. - Bee pollen or bee bread: Pollen pellets packed into honeycomb cells by bees and which undergo natural processing leading to the presence of enzymes and commensal microbiota. It is used by nurse bees to feed the brood. It may not contain any additives except wax from the honeycomb cells. - Beeswax: Substance constituted solely from secretion of the wax glands of worker bees of the species Apis mellifera and used in the construction of honeycombs. - Propolis: Resin of exclusively natural and plant origin, harvested by worker bees of the species Apis mellifera from certain plant sources, to which their own secretion is added (primarily wax and salivary secretion) in order to be used as protection for the hive. - Bee venom: Secretion from the bee's venom gland used by bees to defend against hive attackers.

The Commission shall examine the technical solutions available, and card compatibility issueds, renewed, exchanged and replaced in accordancin order to reduce the amount of card fraud currently taking place The Commission shall communicate with the provisions of Directive 2006/126/ECs findings to the European Parliament within 30 months of the entry into force of this regulation.

Each Member State shall allocate transferable fishing concessions on the basis of transparent criteria, for each stock or group of stocks for which fishing opportunities are allocated in accordance with Article 16, excluding fishing opportunities obtained under sustainable fisheries agreements. 3. Transferable fishing concessions may only be allocated by a Member State to an owner of a fishing vessel flying the flag of that Member State, or to legal or natural persons for the purpose of being used on such a vessel. Transferable fishing concessions may be pooled together for collective management by legal or natural persons or recognized producer organisations. Member States may limit eligibility for receiving transferable fishing concessions on the basis of transparent and objective criteria. 5. Member States may limit the period of validity of transferable fishing concessions to a period of at least 15 years, for the purpose of reallocating such concessions. Where Member States have not limited the period of validity of the transferable fishing concessions, they may recall such concessions with a notice of at least 15 years. 6. Member States may recall transferable fishing concessions with a shorter notice in the event of an established serious infringement committed by the holder of the concessions. Such recalls shall be operated in a manner which gives full effect to the Common Fisheries Policy, the proportionality principle and, whenever necessary, with immediate effect. 7. If no consensus can be reached, dissenting opinions expressed by members shall be recorded in the recommendations adopted by the majority of the members present and voting. d) Each Advisory Council shall designate a chairperson by consensus. The chairperson shall act impartially. e) Each Advisory Council shall adopt the measures necessary to ensure transparency and the respect of all opinions expressed. Recommendations by the executive committee shall be made available immediately to the general assembly, the Commission, member States concerned and, upon request, to any member of the public. f) The meetings of the general assembly shall be open to the public. The meetings of the executive committee shall be open to the public unless, in exceptional cases, decided otherwise by a majority of the executive committee. g) European and national organisations representing the fisheries sector and other interest groups may propose members to the Member States concerned. These member States shall agree on the members of the general assembly. h) Scientists from institutes of the member States concerned or international bodies may be invited to participate as experts in the work of the Advisory Councils. Any other qualified scientist may also be invited. i) The Commission and national and regional administrations of the Member States concerned shall have the right to participate in any meeting of an Advisory Council as active observers. j) Representatives of the fisheries sector and other interest groups from third countries, including representatives from RFMOs, that have a fishing interest in the area or fisheries covered by an Advisory Council, may be invited to participate in the Advisory Council as active observers when issues which affect them are discussed. k) Advisory Councils may apply for financial assistance under EMFF. l) The Commission shall sign a grant agreement with each Advisory Council to contribute to its operational costs, including translation and interpretation costs and the commissioning of technical and scientific reports. m) The Commission may carry out all verifications it considers necessary to ensure compliance with the tasks assigned to the Advisory Councils. n) Each Advisory Council shall transmit annually its budget and a report of its activities to the Commission and to the Member States concerned. o) The Commission or the Court of Auditors may, at any time, arrange for an audit to be carried out either by an outside body of its choice or by the Commission or the Court of Auditors departments themselves. p) Each Advisory Council shall appoint a certified auditor for the period during which it benefits from Community funds.

2. Member States shall determine the use of revenues generated by this Directive. At least 15 % of the revenues generated by the external cost charge in each Member State shall be dedicated to financially supporting TEN-T projects in order to increase transport sustainability. This percentage shall gradually increase over time. The application of the multiplication factor in mountain areas for charging of air pollution costs and noise shall be linked to the requirement to spend the revenues generated in the construction of priority projects of European interest identified in Annex III to Decision No 1692/96/EC.
