Ho votato a favore del provvedimento concernente il progetto del Consiglio, volto all'attuazione di una cooperazione rafforzata sull'istituzione della Procura europea ("EPPO"). Ritengo che essa comporterà una modifica sostanziale alle modalità di tutela degli interessi finanziari dell'Unione e combinerà gli sforzi esplicati, a livello europeo e nazionale, inquadrandoli in un approccio unificato, omogeneo ed efficiente, per combattere le frodi ai danni dell'UE. Condivido che l'EPPO diventi un organismo dell'Unione a struttura decentrata, finalizzato a integrare le autorità nazionali di contrasto, che sia guidato da un procuratore capo europeo e che ogni Stato membro partecipante, sia rappresentato da un procuratore. L'EPPO avrà dunque il compito di indagare, perseguire e portare in giudizio gli autori di reati che ledono gli interessi finanziari dell'UE. In relazione a tali reati, l'azione penale sarà esercitata dinanzi agli organi giurisdizionali competenti degli Stati membri. Apprezzo inoltre il fatto che l'EPPO possa instaurare e mantenere relazioni di cooperazione con le istituzioni, gli organi o gli organismi esistenti dell'Unione (Eurojust, OLAF ed Europol), in particolare relativamente allo scambio di informazioni.

Ho votato a favore della proposta di risoluzione del Parlamento europeo riguardante i sistemi carcerari e le condizioni di detenzione. Credo fermamente che gli Stati membri debbano rispettare le regole in materia di detenzione, derivanti dagli strumenti del diritto internazionale e dalle norme del Consiglio d'Europa. Sono allarmato per i nuovi livelli record di sovraffollamento in alcuni Stati membri, che hanno conseguenze drammatiche per la sicurezza sia del personale penitenziario che dei detenuti. Esorto gli Stati membri a prevedere per i detenuti un programma bilanciato di attività e a prendere in considerazione il reclutamento di volontari a sostegno del personale professionale, al fine di creare collegamenti favorevoli al reinserimento degli individui nella società. Apprezzerei inoltre che gli Stati membri attuassero misure di ristrutturazione delle pene, in particolare per quelle più brevi, attraverso il ricorso alla semilibertà, all'esecuzione della pena durante le ferie per evitare di perdere il posto di lavoro, ai lavori socialmente utili o attraverso un maggiore utilizzo degli arresti domiciliari e del braccialetto elettronico. Inoltre, spero che venga eliminata qualsiasi forma di discriminazione nel trattamento dei prigionieri basata sull'orientamento sessuale o l'identità di genere e vengano garantiti i diritti dei detenuti alla sessualità.

Ho votato a favore della conclusione dell'accordo che istituisce la Fondazione Internazionale EU-LAC, a seguito della votazione della Commissione tenutasi il giorno 30.8.2017. Questo "partenariato strategico biregionale", fondandosi sull'esistenza di relazioni storiche, sociali ed economiche forti e su una comunanza di valori, annovera tra i suoi obiettivi anche un dialogo politico dinamico e la creazione di uno spazio di scambio politico ed economico tra America Latina, Caraibi ed UE.Esso è stato consolidato con l'istituzione della Comunità degli Stati latinoamericani e caraibici (CELAC), creata inizialmente come piattaforma politica regionale formata da trentatré paesi del continente americano e convertitasi poi nella controparte dell'UE nel partenariato strategico. Ritengo che tale relazione possa sfociare in nuove forme e ambiti di collaborazione tra l'UE e l'America latina e i Caraibi, al fine di arricchire e potenziare il processo intergovernativo e rispondere alle sfide che le società di entrambe le regioni devono affrontare.

Ciò, conformemente all'accordo raggiunto dai colegislatori su un progetto di regolamento che istituisce un sistema di ingressi/uscite (EES), rappresenta una condizione preliminare per l'applicazione dell'EES a tali Stati membri.Approvo il progetto di testo del Consiglio senza modifiche e credo che gli Stati membri debbano procedere rapidamente all'adozione di tale decisione. Sostengo inoltre il fatto che il Parlamento inviti il Consiglio ad informarlo qualora intenda discostarsi dal testo approvato dal PE e che chieda ad esso di consultarlo nuovamente qualora intenda modificarne sostanzialmente il testo approvato.

Ho votato a favore della proposta della Commissione avente per oggetto la modifica della direttiva 2009/45/CE relativa alle disposizioni e alle norme di sicurezza per le navi da passeggeri. Ritengo che, sebbene sia relativamente recente, la direttiva necessiti di alcuni aggiornamenti. Credo sia appropriato abolire la regolamentazione europea per le navi di piccole dimensioni, ad eccezione delle unità veloci, lasciando agli Stati membri ampio margine normativo.Condivido la divisione delle zone marittime in più settori, in funzione della pericolosità del mare e, al fine di migliorare l'accessibilità delle prescrizioni nazionali sulla sicurezza delle navi, la creazione, da parte della Commissione, di un data base sulle varie prescrizioni nazionali.Tale proposta è molto utile nella misura in cui agevola l'accesso al diritto, lasciando nel contempo agli Stati membri la possibilità di conservare le rispettive normative nazionali.

Ho votato a favore della proposta di direttiva del Parlamento europeo e del Consiglio che modifica la direttiva 98/41/CE del Consiglio relativa alla registrazione delle persone a bordo delle navi da passeggeri e rientra in una revisione più ampia della legislazione dell'UE in materia di sicurezza delle navi da passeggeri, in conformità del programma di controllo dell'adeguatezza e dell'efficacia della regolamentazione (REFIT) messo a punto dalla Commissione.Credo sia appropriato aggiornare, chiarire e semplificare i requisiti esistenti per il conteggio e la registrazione dei passeggeri e del personale di bordo delle navi da passeggeri, al fine di migliorarne i livelli di sicurezza. Apprezzo che il Parlamento abbia contribuito a numerosi miglioramenti al regime di sicurezza marittima dell'UE in virtù del suo impegno sui tre pacchetti relativi alla sicurezza marittima dell'Unione e che abbia chiesto soprattutto che fosse formulata una proposta legislativa intesa a modernizzare la legislazione sulla sicurezza delle navi da passeggeri.

Sono a favore della proposta della Commissione concernente l'ispezione dei traghetti ro-ro e delle unità veloci da passeggeri che si iscrive nel programma "REFIT". Il 2017 è l'Anno marittimo europeo e dovrebbe quindi essere cruciale per rafforzare il posizionamento del settore marittimo nel mercato interno.Sostengo il fatto che tale proposta miri a eliminare il vuoto, l'incertezza e/o la ridondanza giuridica derivanti dalla coesistenza di due direttive sull'ispezione delle navi, vale a dire la direttiva 1999/35/CE, che prevede ispezioni specifiche per i traghetti ro-ro e le unità veloci da passeggeri, e la direttiva 2009/16/CE, che istituisce un sistema di controllo delle navi da parte dello Stato di approdo, basato sulla valutazione del rischio.Ritengo che le ispezioni debbano essere limitate ai soli traghetti ro-ro e alle unità veloci da passeggeri adibiti a servizi di linea tra un porto di uno Stato membro e un porto di un paese terzo in cui la bandiera battuta dalla nave è la stessa di quella dello Stato membro in questione o adibiti a viaggi nazionali in servizio di linea in tratti di mare in cui possono operare navi di classe A conformemente alla direttiva 2009/45/CE.

Non condivido il progetto di regolamento della Commissione e ritengo che esso oltrepassi le competenze di esecuzione previste nel regolamento (CE) n. 1107/2009. Credo che la CE debba ritirare il progetto di regolamento e presentare un nuovo progetto al comitato.

Non ritengo che tale provvedimento vada diminuire il livello di tutela della vita e della salute umana, della salute e del benessere degli animali, dell'ambiente e degli interessi dei consumatori in relazione agli alimenti e ai mangimi geneticamente modificati. Credo che, non essendo stato dimostrato scientificamente che gli OGM recano danno alla salute umana, debba essere autorizzata l'importazione di tali piante geneticamente modificate rese resistenti a una combinazione di erbicidi, come nel caso della soia DAS-44406-6.

Approvo fortemente la risoluzione del Parlamento europeo sull'eliminazione del matrimonio infantile. Ritengo che debbano essere rispettati tutti i diritti umani e la parità di genere e che l'UE debba rimane impegnata a promuovere, tutelare e realizzare tutti i diritti umani, nonché ad attuare pienamente ed efficacemente la piattaforma di azione di Pechino, la convenzione sull'eliminazione di ogni forma di discriminazione nei confronti della donna (CEDAW), la convenzione di Istanbul e il piano di azione dell'UE sulla parità di genere e l'emancipazione femminile.Il matrimonio infantile costituisce una violazione dei diritti dei minori e una forma di violenza contro donne e ragazze; in quanto tale, deve essere condannato. L'UE e gli Stati membri devono collaborare con UN Women , il Fondo delle Nazioni Unite per l'infanzia, l'UNFPA e altri partner per richiamare l'attenzione sulla questione dei matrimoni infantili, precoci e forzati, incentrando gli sforzi sull'emancipazione delle donne, in particolare attraverso l'istruzione, l'emancipazione economica e una maggiore partecipazione ai processi decisionali, nonché sulla tutela e la promozione dei diritti umani di tutte le donne e le ragazze, anche nell'ambito della salute sessuale e riproduttiva.

Ho votato a favore della risoluzione del Parlamento europeo sulla conferenza delle Nazioni Unite sui cambiamenti climatici in programma nel 2017 a Bonn, visti l'articolo 128, paragrafo 5, e l'articolo 123, paragrafo 2, del suo regolamento.I cambiamenti climatici rappresentano una delle sfide più importanti per l'umanità e che tutti i paesi e gli attori a livello mondiale devono fare del loro meglio per arginare i problemi associati.Credo che l'accordo di Parigi costituisca un importante passo avanti in questa direzione ma che resti ancora molto da fare, poiché il riscaldamento del sistema climatico è inequivocabile, i cambiamenti climatici sono una realtà attuale e le attività umane ne costituiscono la causa predominante.

Sono decisamente favorevole alla restrizione dell'uso di determinate sostanze pericolose nelle apparecchiature elettriche ed elettroniche (AEE), in modo da contribuire alla riduzione dei rischi alla salute e all'ambiente procurati da tali sostanze.Condivido l'applicazione della normativa RoHS 2, intesa a contrastare gli "effetti collaterali indesiderati" della direttiva che emergerebbero dopo il 22 luglio 2019, al fine di limitare la presenza dei 4 ftalati come previsto nella direttiva delegata (UE) 2015/573 della Commissione.Ritengo appropriato che l'elenco delle sostanze soggette a restrizioni sia rivisto periodicamente dalla Commissione di sua iniziativa o a seguito di una proposta presentata da uno Stato membro (articolo 6).
Management, conservation and control measures applicable in the ICCAT Convention area (A8-0173/2017 - Gabriel Mato) IT
Ho votato contro il recepimento delle misure di gestione, conservazione e controllo applicabili nella zona della convenzione della Commissione internazionale per la conservazione dei tonnidi dell'Atlantico (ICCAT), di cui l'Unione è parte contraente dal 1997.La proposta prevede misure per alcune specie marine come i tonnidi tropicali, il tonno bianco dell'Atlantico, il pesce spada, il marlin azzurro e quello bianco, nonché di talune specie particolarmente vulnerabili come squali, uccelli marini e tartarughe.Gli emendamenti proposti, tuttavia, pur mirando ad accrescere la protezione delle specie più vulnerabili e a rispristinare gli equilibri istituzionali cosi come previsti dal regolamento 1380/2013, penalizzano il settore della pesca italiana sotto diversi aspetti. I principali riguardano il riferimento alle quote per i grandi pelagici e l'aumento del periodo di fermo pesca.
Women’s economic empowerment in the private and public sectors in the EU (A8-0271/2017 - Anna Hedh) IT
Ho votato a favore del provvedimento sull'emancipazione economica delle donne nel settore pubblico e privato nell'UE: la relazione contiene diversi punti eticamente sensibili. Ritengo che una condizione preliminare per eccellere nella parità e nell'emancipazione delle donne sia garantire loro la pari partecipazione al mercato del lavoro e alle decisioni economiche.Oltre a essere un diritto umano, un mercato del lavoro più paritario apporta anche vantaggi. Al fine di contrastare l'insufficiente livello di emancipazione economica delle donne nell'UE, credo sia necessario attribuire ai lavori femminili tradizionali un valore uguale a quelli tipicamente maschili. Ciò richiederà obbligatoriamente una migliore retribuzione dei dipendenti da parte dei settori a predominanza femminile interessati.Inoltre, un piano per la parità di genere può operare anche ai fini della prevenzione delle molestie sessuali dato che il 32 % dei casi di molestie sessuali nell'UE è subito dalle donne sul posto di lavoro e, a causa di tale violenza, un gran numero di donne modifica i propri comportamenti evitando di trovarsi sole con un collega o un superiore. Occorre adottare una politica di tolleranza zero contro le molestie e tutti, comprese le donne, devono potersi sentire al sicuro nel loro ambiente di lavoro.
Addressing shrinking civil society space in developing countries (A8-0283/2017 - Teresa Jiménez-Becerril Barrio) IT
Ho votato a favore del provvedimento sulla riduzione degli spazi della società civile nei Paesi in via di sviluppo. Trattandosi di una tematica sensibile (salute e diritti sessuali e riproduttivi), ritengo che, nei casi di repentina e drastica riduzione degli spazi della società civile, gli Stati membri debbano garantire un riconoscimento pubblico ad alto livello del lavoro svolto dalle ONG operanti nel campo dei diritti umani e dai singoli attivisti interessati.Credo che sia necessario un approccio più accomodante alla riduzione degli spazi della società civile e ad altre questioni relative ai diritti umani per quanto concerne paesi con in quali l'UE coopera. La riduzione degli spazi della società civile e le violazioni dei diritti umani possono contribuire alla migrazione forzata.Credo che sia molto importante contribuire attivamente al sostegno di politiche e azioni connesse ai diritti delle donne, anche in materia di salute e diritti sessuali e riproduttivi, e a istituire un elenco di paesi in cui gli spazi della società civile sono maggiormente minacciati.

Ho votato a favore dei negoziati con il Regno Unito a seguito della notifica della sua intenzione di recedere dall'Unione europea dal momento che condivido in toto gli orientamenti approvati dal Consiglio europeo il 29 aprile 2017 e le successive direttive di negoziato adottate il 22 maggio 2017.Accolgo con favore il fatto che il negoziatore dell'Unione stia operando nel pieno rispetto del mandato ricevuto e condivido il fatto che il Primo ministro britannico abbia proposto un periodo transitorio di durata limitata, in cui vigeranno le cosiddette "basic freedoms", ovvero la libera circolazione dei cittadini, dei capitali, dei servizi e dei beni.Oltre a questo, ritengo altresì che il Regno Unito debba continuare a contribuire equamente all'assistenza finanziaria a favore dell'Irlanda del Nord e dell'Irlanda e che debba rispettare gli obblighi finanziari assunti in quanto Stato membro dell'Unione europea, e insisto affinché tale questione sia pienamente risolta nell'accordo di recesso.Credo che il Consiglio europeo debba rinviare la sua valutazione in merito, che è volta a stabilire se siano sufficienti i progressi realizzati sino ora e che il Presidente del PE dovrà trasmettere la presente risoluzione al Consiglio dell'Unione europea, alla Commissione, ai parlamenti nazionali e al governo del Regno Unito.

Ho espresso il mio voto favorevole alla relazione in quanto l'EFSD è il primo pilastro del piano per gli investimenti esterni, nell'ambito del quale la Commissione intende inoltre rafforzare l'assistenza tecnica nei paesi partner (secondo pilastro) e lavorare al miglioramento del clima per gli investimenti e il contesto politico generale in tali paesi (terzo pilastro). Il presupposto principale è che sostenendo gli investimenti e il coinvolgimento del settore privato con fonti innovative di finanziamento si promuoveranno l'occupazione, la crescita e la stabilità nei paesi in via di sviluppo, affrontando in tal modo le cause profonde della migrazione. Inoltre, la Commissione ha proposto, in seno al piano per gli investimenti esterni, di estendere il mandato per i prestiti esterni della BEI.I relatori accolgono decisamente con favore la proposta della Commissione ed esortano le commissioni per gli affari esteri, per lo sviluppo e per i bilanci a cogliere l'opportunità di tale procedura legislativa per perfezionare la progettazione e gli obiettivi dell'EFSD e consentirne il successo.

Ho espresso il mio voto favorevole alla relazione in quanto le imprese devono pagare la loro giusta quota di tasse là dove realizzano i loro utili, tuttavia però dovrebbero essere tassate una sola volta. Al momento la doppia imposizione rappresenta uno dei maggiori ostacoli al mercato interno, poiché crea barriere agli investimenti transfrontalieri e a lungo termine nuoce alla crescita. Tuttavia, le procedure di risoluzione delle controversie attualmente disponibili nell'UE non sono abbastanza efficienti. Alcuni contribuenti preferiscono accettare la doppia imposizione piuttosto che investire tempo e denaro in procedure onerose, che non garantiscono una decisione definitiva vincolante in grado di eliminare la doppia imposizione. Secondo quanto indicato dalla Commissione, attualmente le controversie in materia di doppia imposizione sono circa 900, e l'importo in gioco ammonta a 10,5 miliardi di EUR.Il relatore desidera ricordare quanto osservato dal Parlamento europeo già nella sua risoluzione del novembre 2015, e cioè che la convenzione sull'arbitrato dovrebbe essere sostituita da un meccanismo di risoluzione delle controversie dell'UE che preveda procedure amichevoli più efficaci.

Ho espresso il mio voto favorevole alla relazione, in quanto pur essendo pienamente integrate nell'Unione europea, le regioni ultraperiferiche si sono viste riconoscere dall'articolo 349 del TFUE uno statuto specifico che conferisce all'Unione la capacità giuridica di adeguare a tali regioni l'insieme delle sue politiche, dei suoi programmi e del suo diritto. Tale è inoltre il senso che la Corte di giustizia dell'Unione europea ha dato a detto articolo mediante la sua sentenza del 5 dicembre 2015, che conferma la piena legalità dell'approccio alle RUP.Con la presente relazione il Parlamento europeo ha voluto tracciare un bilancio dell'attuazione dell'articolo 349, analizzare in che modo è possibile approfondire l'adeguamento delle politiche e delle normative europee alle RUP e definire una prospettiva che consenta all'Unione europea di meglio integrare e tenere conto delle RUP.

Ho espresso il mio voto contrario circa la raccomandazione sul tema della lotta alla frode, in quanto la conclusione dei negoziati sulla direttiva relativa al tema sopra citato che lede gli interessi finanziari dell'Unione mediante il diritto penale ("direttiva PIF") rappresenta un momento storico per l'UE. Si tratta del primo passo verso l'armonizzazione del diritto penale in Europa per quanto riguarda i reati commessi ai danni del bilancio dell'UE. I relatori della commissione per il controllo dei bilanci e della commissione per le libertà civili, la giustizia e gli affari interni hanno lavorato su questo tema per più di quattro anni, negoziando assieme con i ministri della Giustizia degli Stati membri. Il Parlamento ha ora stabilito la base giuridica dell'operato della procura europea, definendo le sue competenze.

Ho espresso il mio voto favorevole al provvedimento in esame, perché ho ritenuto che la partecipazione del Kosovo ai programmi dell'Unione, contribuirà al rafforzamento della prospettiva europea del paese e all'approfondimento delle relazioni bilaterali. La conclusione dell'accordo quadro, consentirà la graduale apertura di taluni programmi dell'Unione al Kosovo, o una maggiore partecipazione di quest'ultimo, offrendo la possibilità di promuovere ulteriormente i rapporti nei settori culturale, dell'istruzione, ambientale, tecnico e scientifico e rafforzando i contatti tra le persone e la cooperazione settoriale, oltre a consolidare le relazioni politiche ed economiche attraverso l'accordo di stabilizzazione e di associazione.

Ho espresso il mio voto favorevole al provvedimento in esame in quanto, tale domanda soddisfa le condizioni per un contributo finanziario a valere sul FEG, come indicato all'articolo 4, paragrafo 2, del regolamento FEG.Tale decisione, che va a favore della Spagna, è stata presa, con lo scopo di facilitare il reinserimento professionale dei lavoratori collocati in esubero, presso 5 imprese minerarie, operanti nella divisione 5 della NACE Rev. 2 (Estrazione di carbone e lignite) nella regione di livello NUTS 2 di Castilla y León (ES41). La domanda in esame, riguarda 339 lavoratori collocati in esubero, dato che è inferiore al numero richiesto, stabilito nel regolamento FEG, la Spagna chiede una deroga alle disposizioni dell'articolo 4, paragrafo 1, lettera b), che prevede il collocamento in esubero di almeno 500 lavoratori, nell'arco di un periodo di riferimento di nove mesi, in imprese operanti nello stesso settore economico, definito a livello delle divisioni della NACE Rev. 2, in una regione o due regioni contigue di livello NUTS 2 di uno Stato membro. La deroga è chiesta sulla base del fatto, che il distretto minerario interessato dagli esuberi, è costituito da numerosi piccoli paesi isolati nella zona montana della Cantabria.

Ho espresso voto favorevole sulla relazione, in quanto si basa su diversi punti salienti. Le norme rappresentano uno strumento importante per il funzionamento del mercato unico, per la competitività, la crescita e l'innovazione in Europa, per la qualità, delle prestazioni e della protezione dei consumatori, delle imprese, dei lavoratori e dell'ambiente, nonché per lo sviluppo delle reti e sistemi.Tuttavia, per effetto delle nuove tecnologie e della integrazione delle soluzioni digitali nelle catene del valore industriale globale, l'ambito della normazione sta cambiando rapidamente ed è necessario un nuovo impulso, per dare una risposta efficace alle esigenze normative in oggetto. Inoltre occorre tuttavia affrontare vari ostacoli pratici, in particolare, l'inclusività, l'apertura e la trasparenza del sistema. Le norme più efficaci sono quelle elaborate con il sostegno generale di tutti gli attori in causa. Ho espresso il mio voto favorevole sul provvedimento in quanto le OG, sono sempre state una categoria di strumenti molto specifica. Si tratta di strumenti storicamente consolidati nelle strutture di finanziamento di molti Stati membri, dimostratisi investimenti affidabili. Fanno affidamento su caratteristiche strutturali molto forti, quali la doppia rivalsa. La fiducia degli investitori, è rafforzata dal fatto che le OG, sono soggette a speciale vigilanza pubblica.Pertanto, ritengo giusto il proporre una direttiva europea che definisca e distingua chiaramente due tipi di attività: Obbligazioni garantite (OG) e European Secured Notes (ESN) (titoli di debito garantiti europei). Al fine di evitare inutili perturbazioni sui mercati collaudati delle OG.

Ho espresso il mio voto favorevole al provvedimento, in quanto negli ultimi decenni, molte delle comunità tradizionali di pescatori in tutta l'Unione europea, sono oggetto di crescenti pressioni, provenienti da diversi fattori negativi, quali la pesca eccessiva e il depauperamento degli stock ittici, il cambiamento climatico, l'inquinamento, il decremento demografico, la minore attrattiva della professione di pescatore, ecc.Un numero sempre maggiore di comunità tradizionali di pescatori in Europa, non può più dipendere unicamente dall'attività di pesca tradizionale. Per la ripresa e il mantenimento della redditività di tali comunità, occorre trovare quanto prima delle nuove soluzioni.La diversificazione dell'attività tradizionale in altri settori, tra cui il turismo legato alla pesca, diventa inevitabile e offre potenzialità per contribuire alla creazione di posti di lavoro, all'inclusione sociale e al rilancio delle comunità che dipendono dalla pesca.La redazione da parte della Commissione, di uno studio che esamini diversi aspetti specifici relativi al turismo, legato alla pesca (impatto socio-economico e ambientale) e le buone pratiche già applicate da diversi Stati membri, sarebbe un importante passo avanti.

Ho espresso il mio voto favorevole alla relazione, in quanto sono trascorsi quasi dieci anni, da quando il Parlamento ha approvato una risoluzione sui "Termini di prescrizione nelle controversie transfrontaliere, concernenti lesioni personali e incidenti mortali" (2006/2014 (INL)) e, nonostante le consultazioni pubbliche e gli studi in materia, la Commissione non ha ancora elaborato una proposta legislativa specifica.Il relatore è pertanto convinto che la complessità della situazione e le difficoltà incontrate dai ricorrenti giustifichino l'armonizzazione delle norme in materia di prescrizione. La garanzia dell'accesso alla giustizia e il conseguente sostegno alla libera circolazione delle persone nell'Unione, costituiscono un motivo sufficiente, per armonizzare le norme relative agli incidenti stradali transfrontalieri. Sarebbe pertanto opportuno adottare norme minime riguardanti gli aspetti principali della legislazione sulla prescrizione, in conformità ai principi di sussidiarietà e proporzionalità.

Per questo motivo è intrinsecamente legato al diritto fondamentale a un equo processo e a un ricorso effettivo, garantito dalla Carta dei diritti fondamentali dell'Unione europea (articolo 47 della CDFUE) e dalla Convenzione europea per la salvaguardia dei diritti dell'uomo (articolo 6 della CEDU).Le discussioni sull'armonizzazione della procedura civile nell'UE, sono iniziate più di due decenni orsono, con la presentazione dello studio sul ravvicinamento delle norme di procedura civile degli Stati membri (la cosiddetta "relazione Storme"). Da allora, l'UE ha adottato varie misure finalizzate al ravvicinamento delle norme di procedura civile degli Stati membri.La presente relazione contiene una proposta di direttiva che intende essere un primo passo nel processo di ulteriore armonizzazione e convergenza dei sistemi di giustizia civile degli Stati membri e nella creazione a più lungo termine, di un codice di procedura civile dell'Unione. Mi sono espresso con un voto negativo sulla relazione, sulla proposta di decisione del Parlamento europeo e del Consiglio, relativa alla concessione di assistenza macrofinanziaria a favore della Repubblica di Moldova, in quanto il paese si trova in una fase di ripresa della sua stabilità politica ed economica, dopo due anni difficili. Il paese è entrato in recessione economica nel 2014, anno in cui il noto scandalo bancario e le susseguenti difficoltà di bilancio, provocate dalla sospensione del sostegno dei donatori internazionali, hanno peggiorato la sua performance economica, già colpita dalla contrazione della produzione agricola a causa di condizioni climatiche avverse e dell'andamento negativo delle esportazioni della Moldova verso alcuni dei partner economici tradizionali, in particolare la Bielorussia, la Russia e l'Ucraina.L'applicazione provvisoria (dal settembre 2014) e successivamente l'entrata in vigore dell'accordo di libero scambio globale e approfondito (DCFTA) tra l'Unione europea e la Moldova (parte dell'accordo di associazione UE-Moldova) ha contribuito al processo di ripresa economica. Attualmente l'UE è il principale partner commerciale della Moldova, con una quota del 63% sul totale delle esportazioni moldove. Nel 2015, le importazioni dell'UE dalla Moldova, sono aumentate del 5%, nonostante la contrazione delle esportazioni della Moldova nel resto del mondo.

Mi sono espresso con voto favorevole alla suddetta relazione, in quanto la comunicazione pubblica paese per paese, sui dati fiscali delle imprese, è un elemento fondamentale per contrastare l'evasione e l'elusione fiscali internazionali e la corsa al ribasso, tra i sistemi fiscali. Tuttavia, i benefici della direttiva sono ancora più ampi. Con l'aumento della mobilità e delle attività economiche a livello europeo e mondiale, la trasparenza in termini di comunicazione, è una condizione indispensabile, per una forte governance societaria, nonché uno strumento per rafforzare la responsabilità sociale delle imprese.I relatori ritengono che, al di là degli obiettivi fiscali e di responsabilità societaria, la direttiva rappresenti altresì uno strumento per rafforzare i diritti dei lavoratori all'informazione e alla consultazione. La comunicazione pubblica rafforza il dialogo e promuove la fiducia reciproca all'interno delle imprese, dal momento che può fornire dati obiettivi e affidabili in merito alla situazione delle imprese, sensibilizzando in tal modo tutte le parti interessate, inclusi i dipendenti, riguardo alle esigenze di adattamento. Essa promuove inoltre il coinvolgimento dei dipendenti nel funzionamento e nel futuro dell'impresa e aumenta la competitività.

Ho votato positivamente al provvedimento in esame, visto le osservazioni del relatore, che riconosce le preferenze supplementari a favore dell'Ucraina, che potrebbero sostenere gli sforzi di ripresa economica del paese e il riorientamento dei suoi mercati, verso l'UE. Di fatto, a causa del conflitto in corso nell'Ucraina orientale, delle sanzioni commerciali russe, della conseguente perdita di mercati a Est e del contesto economico mondiale sfavorevole, l'Ucraina si trova in una difficile situazione economica. Attualmente gli scambi commerciali dell'Ucraina con l'UE sono in aumento. Sono cresciuti del 7,5% nel periodo da ottobre 2015 a settembre 2016. Tuttavia, gli effetti della recessione generale non sono del tutto superati. Ho ritenuto giusto che il relatore accogliesse favorevolmente la proroga delle misure restrittive dell'UE nei confronti della Federazione russa, decisa nei mesi di giugno e settembre 2016, concordasse con le raccomandazioni formulate in occasione della quarta riunione della commissione parlamentare UE-Ucraina tenutasi a Kievc il 20 e 21 settembre 2016, in cui si chiede che le misure restino in vigorec fino alla piena attuazione degli accordi di Minsk e al ripristino dell'integrità territoriale dell'Ucraina entro confini riconosciuti a livello internazionale. Ritengo necessario che l'UE mantenga una posizione unita in merito a tale questione.

Ho votato favorevolmente alla relazione inerente al tema della durata di vita dei prodotti, in quanto essa dipende da una serie di attori indipendenti: i fabbricanti, i fornitori, i distributori, i consumatori e persino gli Stati. L'approccio all'allungamento della durata di vita dei prodotti, deve contribuire a sviluppare un modello economico fondato su un equilibrio tra le esigenze dei consumatori, le esigenze degli industriali e gli imperativi ambientali.La Commissione ha cercato, con il pacchetto legislativo dedicato a quest'ultima nel 2015, di sostenere lo sviluppo di un simile modello virtuoso, che preservi le risorse, riduca i rifiuti e crei posti di lavoro in un'economia più competitiva, creando nuovi posti di lavoro a tutti i livelli di qualifica. Secondo le stime, nel settore del riutilizzo e della riparazione, il potenziale di creazione di occupazione è pari a 296 posti di lavoro per ogni 10 000 tonnellate di beni utilizzati. Lo studio condotto dal CESE sull'influenza sui consumatori dell'indicazione della durata di utilizzo dei prodotti, dimostra quanto la competitività delle imprese europee dipenda, in parte, da un ripristino della fiducia dei consumatori nei confronti delle imprese stesse. I suddetti lavori europei, fanno eco alle politiche pubbliche elaborate negli Stati membri.

Mi sono espresso con voto favorevole alla relazione, in quanto secondo i risultati di una serie di studi, le forme di occupazione atipiche sono in aumento nell'UE. Il numero contratti, spesso involontari, a tempo determinato e contratti di lavoro a tempo parziale è aumentato notevolmente nell'UE negli ultimi 15 anni. Allo stesso tempo, le nuove forme di occupazione stanno rendendo meno netti i confini tra lavoro dipendente e lavoro autonomo. Sebbene la crisi economica non sia stata la causa generatrice di queste nuove forme di lavoro precario, le contromisure insufficienti e inadeguate adottate dall'UE per farvi fronte hanno semplicemente acutizzato il problema. Tra queste soluzioni si annoverano le misure di austerità e i memorandum che hanno soffocato la crescita, disgregato il tessuto sociale e impoverito ampie fasce della popolazione. L'attuale crescita apparente dei tassi di occupazione, nasconde l'aumento del ricorso all'occupazione precaria, sotto forma di contratti a zero ore, lavoro autonomo fittizio e lavoro a tempo parziale involontario. L'obiettivo della relazione e l'obiettivo del relatore, è quello di contribuire a conseguire un consenso minimo di base, nella discussione politica sul significato di occupazione precaria, introducendo tra l'altro anche la definizione di lavoro dignitoso, dell'Organizzazione internazionale del lavoro (OIL).

(4) The concept of overriding reasons of public interest is an evolving concept developed by the Court of Justice in its case-law in relation to Articles 34 and 36 of the Treaty. This concept covers, inter alia, the effectiveness of fiscal supervision, the fairness of commercial transactions, protection of consumers, protection of the environment, the maintenance of press diversity and the risk of seriously undermining the financial balance of the social security system. Such overriding reasons, where legitimate differences exist fromare proven by one Member State to another, may justify the application of national rules by the competent authorities. However, such decisions need to be duly justified, the existence of the overriding reason has to be properly proven, and the principle of proportionality must always be respected, regard being had to whether the competent authority has in fact made the least restrictive decision possible. Furthermore, administrative decisions restricting or denying market access in respect of goods lawfully marketed in another Member State must not be based on the mere fact that the goods under assessment fulfil the legitimate public objective pursued by the Member State in a different way from the way that domestic goods in that Member State fulfil that objective. Member States shall provide a written assessment.

(15) The evidence required to demonstrate that goods are lawfully marketed in another Member State varies significantly from Member State to Member State. This causes unnecessary burdens delays and additional costs for economic operators, while preventing national authorities from obtaining the information necessary for assessing the goods in a timely manner. This may inhibit application of the mutual recognition principle. It is therefore essential to make it easier for economic operators to demonstrate that their goods are lawfully marketed in another Member State. Economic operators should be able to benefit from a process of self-declaration, which should provide competent authorities with all necessary information on the goods and on their compliance with the rules applicable in that other Member State. The use of the declaration does not prevent national authorities from taking a decision restricting market access, on the condition that such a decision is: a) proportionate and; b) duly justified; c) the reason for denying market access is fully proven; d) it respects the mutual recognition principle and this Regulation.

It is further appropriate to clarify that in considering whether or not such a situation exists regard may be had, inter alia, to the potential impact of the following: the market in question is to a significant extent served by enterprises which operate under the ownership, control or policy supervision or guidance of the authorities of the exporting country; state presence in firms allowing the state to interfere with respect to prices or costs; public policies or measures discriminating in favour of domestic suppliers or otherwise influencing free market forces; and access to finance granted by institutions implementing public policy objectives. It is further appropriate to provide that the Commission services may issue a report describing the specific situation concerning these criteria in a certain country or a certain sector; the report should cover both sector/company specific and macro/significant distortions, the latter being of particular importance for sectors with high share of SMEs; The assessment of significant distortions is particularly important in the case of heterogeneous sectors composed by a high share of small and medium sized enterprises (SMEs) where evidence of sector specific distortions are the most difficult to find; that such report and the evidence on which it is based may be placed on the file of any investigation relating to that country or sector; and that interested parties should have ample opportunity to comment on the report and the evidence on which it is based in each investigation in which such report or evidence is used.

On the request of the European Parliament or on the Commission's own initiative when circumstances in a specific country or sector have changed the Commission shall initiate or update the report. In any event, the Commission shall carry out a review of the report every two years.
